A novembre un attentato al Presidente ha innescato una nuova ondata di repressione. Un processo a carico dei leader dell’opposizione a seguito dellattacco si è rivelato estremamente iniquo. Un attivista per i diritti civili è stato arrestato per aver esercitato il proprio diritto alla libertà di espressione. Desta preoccupazione lo stato di salute di un prigioniero politico, detenuto da lungo tempo, Mukhametkuli Aymuradov. Obiettori di coscienza continuano ad essere imprigionati. Fonti attendibili continuano a riferire casi di tortura e maltrattamenti.

Contesto
Un attacco al corteo di Saparmurad Niyazov, avvenuto nella capitale Ashgabat il 25 novembre, è stato considerato dalle autorità un tentativo di assassinio e di colpo di stato. Lo Stato ha organizzato dimostrazioni in tutto il Paese in cui venivano chieste pene severe per coloro che erano ritenuti dalle autorità implicati nellattacco; ci sono state anche richieste per la reintroduzione della pena di morte.

Tra le preoccupazioni sollevate dalla comunità internazionale in merito alle notizie di violazioni dei diritti umani a seguito dellattacco, le dichiarazioni dellUnione Europea, dellOrganizzazione sulla sicurezza e la cooperazione in Europa (Osce), e degli Stati Uniti. Il 20 dicembre, gli Stati parte dellOsce hanno invocato il paragrafo 12 del documento di Mosca 1991, che prevede listituzione di una missione dinchiesta speciale di relatori sui motivi di preoccupazione relativi alla conduzione delle indagini sullattacco di novembre.

Nel corso dell’anno diversi alti ufficiali sono stati retrocessi, radiati, o imprigionati, in quella che sembra essere stata a tutti gli effetti una purga per motivi politici. Il Turkmenistan ha richiesto la deportazione di diversi membri dell’opposizione in esilio. Ad aprile il rappresentante per la libertà dei media dellOsce ha reso pubblico un rapporto in cui si condannava il Turkmenistan per ciò che veniva definito come assoluta mancanza di qualsiasi libertà di espressione. Tra gli altri tentativi adottati per limitare lingresso nel Paese di uninformazione indipendente, la messa al bando dellimportazione di quotidiani dalla Federazione Russa.

Giro di vite sui dissidenti e le loro famiglie
Il giro di vite sugli esponenti del dissenso è aumentato sensibilmente in seguito allattacco di novembre. Decine di familiari di persone che avevano criticato il governo, ritenute dalle autorità implicate nellattacco al Presidente, sono stati sottoposti a detenzione, vessazioni ed allontanati dalle loro case. Secondo quanto riferito, molti sono stati presi di mira unicamente a causa del loro legame familiare con gli oppositori del governo. Gli arresti sono stati accompagnati da denunce attendibili di torture e maltrattamenti di molti detenuti. Le autorità turkmene non hanno fornito informazioni complete sui luoghi in cui si trovano i detenuti o le accuse a loro carico.

*Aili Yklymov, uno studente di ventuno anni, e suo fratello Esenaman di 31, sono stati arrestati il giorno dellattacco al Presidente. Secondo fonti attendibili il 5 dicembre Aili Yklymov è stato picchiato così duramente nei sotterranei del ministero della Sicurezza Nazionale a Ashgabat da non riuscire più a camminare e da dover essere portato allinterrogatorio su una barella. Esenaman Yklymov è stato maltrattato durante la custodia cautelare lo stesso giorno in cui è stato arrestato ed è stato visto sanguinare dalle orecchie. Durante la custodia entrambi i fratelli non hanno ricevuto cure mediche per le ferite riportate.

*Secondo quanto riferito, il 29 dicembre, almeno quattro capi dell’opposizione Boris Shikhmuradov, Nurmukhammet Khanamov, Khudayberdy Orazov e Saparmurad Yklymov accusati di aver organizzato lattacco di novembre, sono stati condannati a 25 anni di carcere dalla Corte Suprema in un processo in cui non sono stati affatto rispettati gli standard internazionali; gli ultimi tre sono stati condannati in contumacia. Il giorno dopo, le sentenze sono state aumentate allergastolo dal Khalk Maslakhaty, il massimo organo legislativo del del Turkmenistan. In una “confessione” trasmessa dalla televisione, che si ritiene sia stato costretto a pronunciare, Boris Shikhmuradov affermava: Io e i miei alleati […] non siamo membri dell’opposizione ma criminali comuni e tossicodipendenti abituali […] non cè una sola persona onesta tra di noi; siamo tutti delinquenti […] Non sono una persona capace di governare uno Stato […] sono un criminale capace solamente di distruggere lo Stato. In una dichiarazione apparsa sul suo sito web un giorno dopo che le autorità avevano riferito la sua detenzione il 26 dicembre, Boris Shikhmuradov ha negato un suo coinvolgimento nellattacco di novembre.

*Il prigioniero politico Mukhametkuli Aymuradov, detenuto da lungo tempo, è rimasto agli arresti per tutto l’anno. Era stato dichiarato colpevole nel 1995, accusato tra laltro di tentati atti terroristici, e condannato a 12 anni di prigione in seguito a un processo con ogni probabilità iniquo. Nel dicembre 1998 aveva ricevuto unulteriore condanna a 18 anni di carcere in relazione a un presunto tentativo di evasione. È stato riferito che gli sono state negate adeguate cure mediche per infarto, ulcera gastrica e infiammazioni ricorrenti ai reni, vescica e cistifellea. Fonti non ufficiali dicono inoltre che la vista di Mukhametkuli Aymuradov è peggiorata. Secondo un regolamento in vigore da gennaio, alla moglie sarebbe concesso di visitarlo una volta ogni tre mesi per 20 minuti.

Società civile
Membri della società civile continuano a subire pressioni dalle autorità. Nessun gruppo portavoce dei diritti umani può agire apertamente in Turkmenistan.

*Farid Tukhbatullin, attivista per i diritti civili ed ecologista, è stato arrestato il 23 dicembre nella sua città di residenza, Dashoguz, nel nord del Turkmenistan. È stato trasportato in aereo ad Ashgabat lo stesso giorno e portato al ministero della Sicurezza Nazionale dove è stato tenuto in incommunicado per tre giorni. Il 26 dicembre Farid Tukhbatullin è stato incriminato per aver attraversato illegalmente la frontiera tra Turkmenistan e Uzbekistan e per aver nascosto un grave atto criminale. Questultima accusa farebbe riferimento alla sua partecipazione ad una conferenza tenuta allinizio di novembre a Mosca, la quale era stata organizzata da gruppi per i diritti umani. Secondo quanto riferito, è stato accusato di essersi rifiutato di rivelare informazioni in merito ai piani di gruppi di opposizione in esilio di compiere un colpo di stato che, secondo le autorità, furono discussi durante la conferenza. Amnesty International, che aveva inviato una sua delegata alla conferenza, ritiene che Farid Tukhbatullin sia stato accusato come punizione per lesercizio del suo diritto alla libertà di espressione e per le sue pacifiche attività come attivista dei diritti civili. L’organizzazione lo considera prigioniero di coscienza.

Libertà di religione
Nel corso dell’anno, alcuni obiettori di coscienza hanno scontato dei periodi di detenzione. Un prigioniero battista è stato rilasciato in seguito a pressioni internazionali. Membri di gruppi religiosi minoritari, uomini e donne, hanno continuato a subire vessazioni, deportazioni e sono stati reclusi.

*Nikolay Shelekhov, un Testimone di Geova di ventuno anni, è stato condannato a 18 mesi di carcere per aver rifiutato di servire nell’esercito per motivi religiosi; questa era la seconda condanna per lo stesso reato. I suoi appelli sono stati respinti a ottobre rispettivamente dal Tribunale di Ashgabat e dalla Corte Suprema. Nikolay Shelekhov soffriva ancora di problemi di salute, tra cui disturbi renali, contratti durante il suo precedente imprigionamento avvenuto tra agosto 2000 e dicembre 2001.

Le riforme giuridiche hanno condotto allabolizione della pena di morte per i reati commessi in tempo di pace e ad alcuni emendamenti alle leggi che limitano la libertà di espressione. Tuttavia, molti prigionieri di coscienza hanno continuato ad affrontare processi o ad essere detenuti, specialmente per aver espresso opinioni sulla questione curda, sulle carceri di massima sicurezza di tipo F o per aver manifestato opinioni di orientamento islamista. La tortura durante la custodia di polizia è rimasta diffusa ed è stata esercitata sistematicamente nelle sezioni anti-terrorismo delle stazioni di polizia situate nel sud-est del Paese. I responsabili di tali atti raramente sono stati portati in giudizio. Sono state segnalate decine di uccisioni da parte di membri delle forze dell’ordine; alcune di queste potrebbero essere esecuzioni extragiudiziali.

Contesto
Le riforme allordinamento giuridico sono state introdotte dal governo di coalizione di Bülent Ecevit allo scopo di rispondere ai criteri necessari per laccessione allUnione Europea. La pena di morte è stata definitivamente abolita ad agosto con leccezione dei reati commessi in tempo di guerra o di minaccia imminente di guerra. Nei mesi di febbraio, marzo ed agosto il parlamento ha emanato tre leggi con lobiettivo di adattare la legge turca agli standard europei in materia di diritti umani. Insieme allabolizione della pena di morte, le altre riforme riguardavano modifiche ai regolamenti penitenziari ed emendamenti a leggi utilizzate in passato per limitare il diritto alla libertà di espressione. Tuttavia, alcuni di questi cambiamenti giuridici si sono rivelati ambigui ed insufficienti ad affrontare gli abusi dei diritti umani per i quali si suppone fossero stati studiati. Inoltre, spesso i cambiamenti non hanno poi avuto applicazione nella pratica.

A marzo, Amnesty International ha ottenuto il permesso aprire una sezione in Turchia in base alla Legge sulle associazioni.

Nel sud-est del Paese, a maggioranza curda, lo stato di emergenza è stato revocato in due province a luglio e nelle restanti due nel mese di novembre.

A novembre si sono svolte elezioni politiche anticipate dopo che diversi ministri si erano dimessi dal governo di coalizione costituito dal Partito democratico di sinistra (Dsp) del primo ministro Bülent Ecevit, dal Partito di azione nazionalista (Mhp) e dal Partito della madrepatria (Anap). Il Partito della giustizia e dello sviluppo (AK) è stato eletto al governo con la maggioranza assoluta. Degli altri partiti politici, soltanto il Partito popolare repubblicano (Chp) ha ottenuto seggi in parlamento. Il vicesegretario del partito AK, Abdullah Gül è stato nominato primo ministro. Il segretario del partito AK, Recep Tayyip Erdoðan, un ex prigioniero di coscienza, non ha potuto candidarsi al parlamento a causa della sua precedente condanna.

A dicembre, il nuovo governo ha introdotto un pacchetto di riforme legali mirate ad alcune questioni chiave nell’ambito della tutela dei diritti umani, tra cui la tortura, l’impunità e la libertà di espressione.

Prigionieri di coscienza
Molte persone, tra cui scrittori, giornalisti, sindacalisti, politici locali e nazionali, leader religiosi e attivisti per i diritti umani, hanno continuato ad essere imprigionate o processate per aver esercitato il diritto alla libertà di espressione.

Le nuove disposizioni giuridiche hanno ristretto le definizioni dei reati punibili per legge e, in alcuni casi, hanno ridotto le pene massime erogabili, ma la loro ambiguità è stata ancora motivo di preoccupazione. In diversi casi, dopo lapprovazione delle nuove leggi le condanne sono state riviste o le accuse sono state ritirate, tuttavia molti prigionieri di coscienza sono rimasti in prigione e i processi politici sono continuati. Rappresentanti di organizzazioni per i diritti umani, partiti politici e sindacati che si opponevano all’isolamento nelle prigioni di tipo F hanno continuato ad essere incriminati secondo lart.169 del codice penale per complicità con organizzazioni armate illegali e molti sono stati considerati prigionieri di coscienza.

*Nel maggio 2001 Turgut Koçak, Hasan Yavaº e Necmi Özyurda, appartenenti al Partito socialista operaio della Turchia (Tsip), furono condannati a 45 mesi di carcere con laccusa di aver aiutato e protetto esponenti di gruppi armati per aver appoggiato le proteste contro le prigioni di tipo F. Laccusa si riferiva ad una manifestazione organizzata nel dicembre 2000 davanti all’ufficio del Tsip. Nella perquisizione successiva, allinterno dei locali del Tsip furono trovati cartelli e bandiere che si riferivano allo sciopero della fame contro le prigioni di tipo F, ma Turgut Koçak, Hasan Yavaº e Necmi Özyurda avevano affermato che tali oggetti erano stati depositati nella sede del partito da altre persone. Il verdetto è stato confermato nel mese di novembre 2001. Turgut Koçak e Necmi Özyurda sono stati incarcerati a marzo e Hasan Yavaþ a maggio.

Tortura e maltrattamenti
Sono continuate a pervenire segnalazioni di tortura, che hanno evidenziato il crescente impiego di metodi che non lasciano segni visibili sul corpo. I detenuti hanno continuato ad essere sottoposti a trattamenti quali scosse elettriche, sospensione per le braccia e la falaka (percosse sotto la pianta dei piedi). Altri metodi di tortura e di maltrattamenti regolarmente segnalati comprendono gravi percosse, abusi sessuali, lessere colpiti con violenti getti d’acqua fredda pressurizzata, lessere denudati durante gli interrogatori, minacce di morte e di stupro, altre torture psicologiche, privazione del sonno, del cibo, di qualsiasi bevanda e la proibizione ad usare i servizi igienici. Secondo i rapporti, le donne e le ragazze arrestate hanno subito frequentemente abusi di tipo sessuale e sono state minacciate di stupro. Diverse donne sono state stuprate.

Tra le vittime vi erano persone sospettate di attività filo-curde, islamiste o di sinistra, o coloro che avevano richiesto l’istruzione in lingua curda. Altre persone sono state arrestate perché sospettate di aver compiuto reati penali o soltanto per non aver obbedito agli ordini degli agenti delle forze di sicurezza. I sospettati di furto o di scasso – tra cui molti bambini – sono stati regolarmente picchiati durante il periodo di detenzione.

*Hamdiye Aslan, una donna curda di 37 anni madre di cinque figli, è stata fermata a marzo a Mardin, nella provincia di Kýzýltepe e trattenuta per due giorni presso la sezione anti-terrorismo della polizia di Mardin. Secondo quanto riferito, la donna è stata spogliata e sodomizzata con un manganello, bendata e minacciata, schernita quando ha supplicato i suoi torturatori. Hamdiye Aslan è stata trattenuta nella prigione di Mardin per quasi tre mesi fino al momento del rilascio in attesa del processo. I referti medici hanno confermato le sue denunce di tortura. Il procuratore di Mardin ha aperto un’indagine su cinque agenti di polizia accusati di averla torturata, mentre l’Ordine dei medici turco ha aperto una procedura contro due medici che avevano precedentemente dichiarato che la donna non era stata torturata.

*Il 3 aprile Tekin Demir è stato arrestato insieme al figlio in casa propria alle 5 del mattino perché sospettato di fiancheggiare una organizzazione illegale. Entrambi sono rimasti per due giorni presso la sezione anti-terrorismo della polizia di Ankara. Secondo le informazioni ricevute, durante la custodia, Tekin Demir è stato tenuto bendato, denudato, ha ricevuto scosse elettriche, è stato colpito con getti d’acqua fredda, percosso e minacciato, gli sono stati strappati i capelli e i baffi e le dita sono state ustionate con acqua bollente. Gli agenti gli hanno inoltre pestato le mani mentre giaceva sul pavimento. Durante la visita medica alla quale è stato sottoposto prima del rilascio, il medico non ha annotato alcuna lesione ma, dopo che Tekin Demir ha sporto denuncia formale, un nuovo esame medico-legale ha rilevato numerose lesioni ed altri problemi clinici.

Custodia di polizia prolungata e detenzione in incommunicado
A seguito di un emendamento costituzionale approvato nell’ottobre 2001, a febbraio il parlamento ha emanato una legge che riduce a quattro giorni il periodo massimo di custodia iniziale presso la polizia o la gendarmeria prima che gli arrestati vengano condotti dal giudice. Inoltre, la nuova legge ha ridotto da quattro giorni a 48 ore la durata massima della detenzione in incommunicado per i detenuti sospettati di reati che ricadono sotto la giurisdizione dei Tribunali per la sicurezza dello Stato. Tuttavia, tali modifiche non sono state in grado di porre termine al diffuso impiego di tortura e maltrattamenti, che si verificano principalmente nelle prime 24 ore di detenzione.

***Impunità
Le vittime di tortura che hanno tentato di portare le loro denunce in tribunale hanno continuato ad incontrare grossi ostacoli. Poiché i detenuti erano frequentemente bendati, non era possibile identificare i torturatori. Spesso i referti medici che provavano lavvenuta tortura sono stati distrutti e i medici che hanno documentato la tortura sono stati minacciati. L’intimidazione delle vittime e dei testimoni e un clima generalizzato di timore hanno anche contribuito a mantenere l’impunità, così come ha fatto la riluttanza dei procuratori ad indagare sul comportamento dei membri delle forze di sicurezza. Le dichiarazione estorte sotto tortura sono state frequentemente accolte come prova durante i processi e spesso i giudici si sono rifiutati di indagare sulle denunce di tortura.

Il ritardo nellaprire procedimenti in un certo numero di casi eclatanti di tortura ha provocato limpossibilità di portare i responsabili in giudizio. Gli imputati che erano agenti di polizia non si sono presentati alle udienze, in alcuni casi i loro avvocati si sono dimessi o non hanno presentato in aula il materiale richiesto.

*Gülderen Baran fu torturata nel 1995 mentre si trovava in custodia presso la sezione anti-terrorismo della polizia di Istanbul. La sospensione ripetuta per le braccia le provocò la perdita della capacità di movimento ad entrambi gli arti. Al termine del processo fu condannata allergastolo. Cinque agenti di polizia accusati di averla torturata furono portati in tribunale. Malgrado un commissario e un agente avessero ammesso, durante il processo, di aver usato la forza e di averla picchiata, il caso è stato archiviato il 12 marzo per decorrenza dei termini. Gli agenti sotto processo non vennero sospesi dal servizio nel corso del procedimento e, in seguito, uno di loro è stato promosso al grado di soprintendente capo.

*Il 16 ottobre sono stati condannati a periodi di detenzione compresi tra 5 e 11 anni i dieci agenti di polizia accusati di aver torturato, nel 1996, quindici minorenni ed un insegnante durante la custodia di polizia nella città di Manisa.

Carceri di massima sicurezza
Lisolamento nelle prigioni di massima sicurezza ha continuato ad essere argomento di acceso dibattito. Le autorità hanno proseguito nella costruzione di ulteriori 11 penitenziari di tipo F e ad aggiungere, alle carceri già costruite, nuove sezioni in cui i dormitori sono stati sostituiti con piccole celle. Migliaia di reclusi in sei prigioni di tipo F già funzionanti sono stati tenuti in isolamento prolungato o in isolamento a piccoli gruppi, trattamenti che possono configurarsi come crudeli, inumani o degradanti. Gli scioperi della fame contro le carceri di tipo F sono continuati e nel corso dell’anno hanno causato la morte di 21 persone, portando il numero totale di decessi determinati dallo sciopero della fame ad almeno 57. Sebbene a ottobre il ministro della Giustizia abbia tolto la restrizione ai colloqui privati dei detenuti in precedenza subordinati alla partecipazione a programmi di formazione tali riunioni sono state limitate a cinque ore alla settimana, non rispondendo così alle raccomandazioni del Comitato europeo per la prevenzione della tortura. Sono giunte diverse segnalazioni circa i maltrattamenti subiti dai detenuti allinterno delle prigioni di tipo F, ma si sono rivelate difficili da verificare a causa dellaccesso limitato a tali strutture.

Diritti delle minoranze
Nel mese di settembre la Turchia ha ratificato la Convenzione internazionale per leliminazione di ogni forma di discriminazione razziale.

Nonostante le riforme legislative volte ad alleggerire le restrizioni in merito alla possibilità di esprimere pubblicamente lidentità curda, gli osservatori non sono riusciti a notare miglioramenti significativi nella pratica. Ad agosto una modifica legislativa ha permesso lintroduzione di corsi di lingua e trasmissioni radio-televisive in lingue tradizionalmente usate e parlate dai cittadini turchi nella vita quotidiana. Tuttavia, una settimana dopo lapprovazione di questa modifica, il ministero dell’Istruzione ha rimosso dalla cattedra il leader del sindacato degli insegnanti di Diyarbakýr, a quanto pare per aver sostenuto in un discorso la diffusione di trasmissioni in lingua madre. Nessun corso di studi in lingua curda è stato finora approvato dalle autorità e migliaia di persone sono state arrestate per aver firmato petizioni in cui chiedevano il diritto ad essere istruiti in curdo. Alcuni dei fermati pare siano stati torturati o maltrattati. Alcuni sono stati accusati di sostenere organizzazioni armate illegali quali il Pkk (Partito dei lavoratori del Kurdistan) o la sua filiazione, il Kadek. Tuttavia, in seguito allemendamento alla legge, pare che alcuni dei fermati siano stati rilasciati mentre per altri il processo è ancora in corso.

Nel corso dell’anno sono stati aperti diversi processi contro genitori che hanno provato a registrare allanagrafe i loro bambini con nomi curdi.

*Abdullah Yaðan è stato condannato a luglio a 45 mesi di carcere dal Tribunale per la sicurezza dello Stato di Diyarbakýr per aver fatto ascoltare musica curda ai passeggeri del suo minibus.

*A luglio il procuratore di Siirt ha avviato una causa affinché i genitori siano costretti a cambiare i nomi curdi dei loro bambini. Il caso riguarda i bambini di 19 famiglie nati tra il 10 luglio 1997 e il 19 marzo 2002.

*Il 10 maggio undici insegnanti ed un ingegnere sono stati arrestati e, secondo le segnalazioni, torturati e maltrattati dalla polizia, che li avrebbe percossi con libri scritti in curdo. Il 5 settembre il Tribunale per la sicurezza dello Stato li ha prosciolti dallaccusa di fiancheggiamento di un’organizzazione illegale. Tuttavia, un’inchiesta interna del ministero dell’Istruzione ha provocato il trasferimento in altre regioni del Paese di dieci insegnanti poiché erano stati trovati nelle loro abitazioni libri scritti in curdo.

Difensori dei diritti umani
Gli attivisti locali per la difesa dei diritti umani hanno continuato a subire vessazioni, intimidazioni e ad essere processati.

*Osman Baydemir, capo dellufficio di Diyarbakýr della Associazione per i diritti umani (Ýhd), ed Eren Keskin, responsabile della sezione di Istanbul dellÝhd sono stati accusati per la loro attività in difesa dei diritti umani. Il presidente della sezione dellÝhd di Bingöl, Rýdvan Kýzgýn, è stato arrestato a gennaio dopo avere assistito alla commemorazione di due rappresentanti del partito pro-curdo Partito democratico popolare (Hadep), legalmente riconosciuto, che erano “scomparsi” nel mese di gennaio 2001. A marzo è stato liberato in attesa del processo.

*Nel processo istruito a seguito di unirruzione della polizia avvenuta nel settembre 2001 nell’ufficio di Diyarbakýr della Fondazione turca per i diritti umani, il rappresentante dell’ufficio, lavvocato Sezgin Tanrýkulu, è stato assolto ad aprile dallaccusa di aver aperto un centro medico senza permesso. Tuttavia, a ottobre un nuovo processo è stato aperto contro Sezgin Tanrýkulu e contro Eren Keskin [f], accusati di aver insultato le forze armate turche e le forze di sicurezza durante un convegno sui diritti umani organizzato, nel dicembre 2001, dall’ufficio di Diyarbakýr dellÝhd. unregistered religious activity is strictly illegal here and obtaining
church registration can be difficult, if not impossible. Police and the
secret services monitor Christian activities. This strict surveillance
makes it difficult for churches to teach the gospel. The local
authorities are hostile towards Christians; dozens of believers were
detained for short periods in 2011. The printing and importing of
religious literature is effectively banned. Indigenous believers face
open hostility of family and community and come under constant pressure
to recant their faith.

Pastor Nuriev’s release from prison! I want to continue to pray for
this nation and the expansion of the gospel there. I pray that You
would make ways for churches to be registered and to have more freedom
to share the gospel and lead people to You. I pray Your protection over
all who endeavor to do Your work in this place. I pray also that You
