La storia ha inizio nell’ottobre del 2019, quando Daniele, allora trentottenne e stimato istruttore di sport da combattimento con un ampio seguito sui social, decide di non voltarsi dall’altra parte.

Davanti a un pub, interviene per difendere due ragazzi minorenni inseguiti da un uomo visibilmente alterato dall’alcol e armato di un pesante portaombrelli. Quello che doveva essere un atto di civismo si è trasformato però in un incubo legale culminato in una condanna a sei anni e mezzo di reclusione.

La dinamica dei fatti e la reazione di difesa
Secondo le ricostruzioni, l’aggressore aveva iniziato a minacciare i giovani perché si sentiva deriso. Così Daniele, dopo aver tentato un richiamo verbale e aver risposto a una carica a testa bassa con un ceffone, si è trovato di fronte a una minaccia ancora più grave: l’uomo aveva dichiarato di voler prendere una pistola dalla propria auto.

Per neutralizzare il pericolo imminente, Daniele ha quindi preso la decisione di sferrare due pugni che hanno messo fuori gioco l’aggressore. Nonostante la prognosi iniziale di soli 20 giorni rilasciata dal Policlinico Gemelli, la vicenda ha preso una piega inaspettata quando la vittima, tre mesi dopo, si è sottoposta a un intervento per un danno a una palpebra, dando il via a un iter giudiziario severissimo.

L’applicazione dell’articolo 583-quinquies e l’assurdità della pena
Il cuore della controversia legale risiede nell’applicazione dell’articolo 583-quinquies del Codice Penale, ovvero la “deformazione dell’aspetto della persona mediante lesioni permanenti al viso”.

Una norma che, nata originariamente per contrastare gli atroci attacchi con l’acido contro le donne, è stata applicata al caso di Daniele nonostante la natura della sua reazione fosse legata a una difesa.

Sebbene la Cassazione avesse riconosciuto la reazione a un’aggressione annullando una prima sentenza, il nuovo appello ha ridotto la pena di un solo mese, portandola a sei anni e cinque mesi totali. Una severità apparsa stridente all’opinione pubblica, se confrontata con la dinamica di un alterco nato per proteggere terzi.

Durante il periodo trascorso nel braccio G8 di Rebibbia, Daniele non ha mai abbandonato la sua vocazione di educatore sportivo. Nonostante il percorso scolastico intrapreso, la partecipazione a corsi di teatro e l’ottima condotta, non ha ottenuto benefici significativi dai magistrati di sorveglianza.

Oggi, uscito per fine pena, attende l’esito di un ricorso basato sulla recente pronuncia della Corte Costituzionale, che permette riduzioni fino a un terzo per i casi di lieve entità legati proprio al reato di lesione del volto.
