Recently, the leading environmental and health advocacy organizations that filed the case presented 11,000 pages of evidence to support their claims. (Links to the evidence are provided below.) The case is before the U.S. Court of Appeals for the D.C. Circuit. Oral arguments are scheduled for Jan. 25 at 9:30 a.m. EST. The public can listen on YouTube.
In December 2019, the FCC closed an investigation that began in 2013 in which the commission asked the public to submit comments to the inquiry’s docket regarding whether the FCC should revise its 1996 health guidelines for radiofrequency (RF) radiation from wireless devices and infrastructure.
About 2,000 comments — an exceptionally high number — were filed with the FCC. These comments were submitted by scientists and scientific organizations, such as the BioInitiative and EMF Scientist, physicians and medical organizations, cities, such as Boston and Philadelphia, and hundreds of individuals including parents of children injured by this technology. The comments referenced thousands of studies showing clear and profound evidence of harm.
However, the FCC’s order, released on December 4, 2019, concluded that there is no evidence that wireless technology causes harm and that there is no need to revise the guidelines. The FCC’s decision failed to provide a review of the science, ignored evidence of disease, and failed to support its decision with evidence. As a result, two lawsuits were filed against the FCC. One by the Environmental Health Trust (EHT) and Consumers Safe Cell Phones and one by Children’s Health Defense (CHD) and additional petitioners including Prof. David Carpenter who is the co-editor of the BioInitiative Report, the most comprehensive review of the science by 29 leading scientists and public health experts. The CHD case was also joined by doctors who see the disease in their clinics and by parents of children who have gotten radiation sickness. One petitioner is a mother whose son died from glioblastoma, the same brain tumor that killed Beau Biden, President Joe Biden’s son.
The petitioners in the EHT and CHD cases filed joint briefs. They argued that, given the overwhelming evidence presented to the FCC docket, and because the FCC order lacked evidence of a reasoned decision-making process, the FCC violated the Administrative Procedures Act and that the Commission’s decision was capricious, arbitrary, an abuse of discretion, and not evidence-based.
The petitioners further argued that the FCC violated the National Environmental Policy Act (NEPA) because the Agency failed to consider the environmental impacts of its decision, and failed to comply with the Telecommunications Act of 1996 (TCA) because it failed to consider the impact of its decision on public health and safety.
