I FATTI scippato il “registro di classe” agli ultimi minuti di lezione, gli alunni fuggono al suono della campana non attendendo il docente per espletare una uscita ordinata dall’Istituto Scolastico, tuttavia il Dirigente ritiene il docente comunque colpevole per avere mancato ai suoi doveri di vigilanza sulla Classe. 1. e 2 ]. Stante la mia oggettiva ragione, nel contenzioso, quale sindacato mi offre la tutela legale, nella eventualità si renda necessario fare un ricorso al giudice del lavoro? Lo scrivente sarà prossimamente convocato all’Ufficio Scolastico Provinciale, dall’Ufficio Conciliazione. 3. con la distruzione della civiltà ebraico-cristiana, noi assistiamo ad un progressivo deterioramento sociale, ed il bullismo a scuola è parte di questo deterioramento nelle relazioni interpersonali ed istituzionali. Nella fattispecie è facile per un Dirigente (con i nuovi “super poteri” che la autonomia ha concesso a lui), dire al docente in difficoltà “vattene altrove, questo non è un posto adatto a te”, o ancora peggio amplificare con atti formali il crimine degli alunni “vandali” facendo diventare la Istituzione Scolastica una specie di Istituzione a delinquere. piuttosto che in modo assai più problematico impegnativo ma virtuoso, di attivare gli interventi idonei al recupero ed alla promozione sociale di questi alunni, dall’inquietante loro potenziale distruttivo anche a livello sociale. Convocazione per audizione di difesa. Come già dettagliatamente esplicitato non soltanto nella tempestiva mia comunicazione circa la sottrazione del Registro di Classe avvenuta il 12 marzo alla fine dell’ultima ora di lezione, ma altresì nella mia successiva comunicazione Prot. 2225/CI del 25.03.2013, con Oggetto “Comunicazione disciplinare Classe Prima Meccanici ” lo scrivente * respinge ogni forma di addebito a suo carico perché era presente nell’aula scolastica e stava svolgendo le sue funzioni, avendo custodito il Registro di Classe in modo più che adeguato sulla cattedra sotto un voluminoso carteggio composto da dispense, sussidi, libri di testo ed i registri personali. *-. è stato confortato sia da diversi sindacati che da Istituzioni gerarchiche come proprio la Sua dizione “senza che Ella se ne rendesse conto” rappresenta una ammissione giuridica di non colpevolezza. *-. rammenta la sua venticinquennale carriera caratterizzata da lealtà, generosità, trasparenza, puntualità, disponibilità al dialogo ed al confronto, *-.evidenzia come il più delle volte sia il primo di tutti i docenti a giungere in questa Istituzione Scolastica al mattino; *-. consente a tutti gli alunni dell’Istituto di avere cura di un quaderno di religione dove non soltanto c’è una traccia oggettiva di parte del lavoro svolto, ma altresì esso è uno strumento prezioso per elaborare una valutazione condivisa e motivata del voto di religione con gli alunni; *-. ha aderito con convinzione a tutte le proposte della Presidenza durante i vari Collegi dei docenti, anche se queste comportavano per lui un ulteriore aggravio di lavoro, come è stata la scelta del trimestre che ha visto per il solo docente di religione un uso eccessivo dei Consigli di Classe dovuti agli scrutini, che solo per lui non sono stati a “costo zero”, come la S.V. promise a tutti; *-. ha ampiamente superato le 40 ore dovute per legge alla partecipazione dei Consigli di Classe, tuttavia, per svolgere al meglio il suo servizio nella Comunità Scolastica, partecipa a ulteriori e diverse sessioni a titolo gratuito, come appunto è stato nella riunione del 04.04.2013 dove i genitori della Prima Meccanici sono stati convocati per discutere circa la sottrazione del Registro di Classe. *-. considera, circa le motivazioni per cui gli alunni hanno sottratto il Registro di Classe, come il sottoscritto abbia trascritto meno note disciplinari degli altri suoi colleghi soltanto perché alla sesta ora del Martedì non esisteva più materialmente uno spazio disponibile per apporre altre note disciplinari. Questo a riprova della difficile situazione didattica di tale scolaresca tendente a esprimere un condizionamento dei comportamenti posti in essere in relazione ai leader negativi, e forse è in questa complicità negativa che potrebbe essere trovata anche la spiegazione 1. dell’abbandono scolastico di un cospicuo numero di studenti della classe stessa, 2. della fonte di stress, frustrazione e pericolo accentuato per supplenti e docenti di materie, a torto ritenuti secondari da parte degli alunni stessi. *-. visti i condivisi giudizi circa i relativi risultati di apprendimento e scolarizzazione della scolaresca, lo scrivente si interroga continuamente sulle strategie da utilizzare per meglio superare le sue situazioni di criticità, ed a tale proposito si dichiara sempre disponibile ad un confronto sincero. N. 2352/C1, e suo inoltro per le vie gerarchiche al fine di stimolare una virtuosa riflessione. 1. Circa la sua comunicazione Prot. n° 2352/C1, del 27/03/2013 non si capisce perché stando io a scuola, essa sia dovuta giungere a casa mia per posta ordinaria, mentre tale comunicazione istituzionale sarebbe potuta andare smarrita.
- Mi scuso con la S.V. per la punteggiatura da me utilizzata che ha offeso la sua sensibilità, ma utilizzando da cinque anni ininterrottamente per otto ore al giorno il traduttore di Google, per pubblicare vari articoli a tutela dell’occultato fenomeno del martirio dei cristiani e per difendere la “Speranza di Israele”, ho come disimparato l’uso corretto della punteggiatura della lingua italiana, infatti un abbondante uso della punteggiatura è indispensabile per poter ottenere delle traduzioni attendibili. 3. in realtà, la sua comunicazione Prot. n° 2352/C1, del 27/03/2013 non è una risposta alle mie istanze ma è sostanzialmente, una serie di insulti ed illazioni contro la mia onorabilità e professionalità, e questo suo atteggiamento formale rappresenta soltanto in parte, quello che la mia mitezza e senso delle istituzioni hanno dovuto subire privatamente nel suo ufficio, durante il presente anno scolastico e di come da gravi quanto infondate accuse lo scrivente abbia dovuto giustificare il suo comportamento non soltanto alla presenza del Direttore dell’Ufficio Scuola don , ma vista la gravità delle accuse rivoltemi, sia pure in modo non formale, si sia resa necessaria addirittura la presenza del Vicario Episcopale Mons. , tuttavia, tale evento è stato a riprova della mia innocenza, perché tali accuse si sono rivelate una distorsione della realtà. [Prima nota di interesse Istituzionale] La vicenda da me vissuta evidenzia anche l’abuso di potere che molti Dirigenti Scolastici commettono ai danni di alcuni docenti, esautorando già in prima istanza, il loro dovere diritto di interloquire con fantomatici genitori anonimi. In questo modo, alcuni docenti si vedono colpiti nel buio da accuse distorte e spesso da calunnie che piovono in modo anonimo contro di loro senza che a loro venga offerta la possibilità di un chiarimento con la parte interessata. Ma questo comportamento, per me illegale, porta ad insinuare nel Dirigente Scolastico il sospetto circa la non adeguatezza di un tale docente alle mansioni a lui affidate. Mentre è proprio il Dirigente con il suo abuso di potere a interporsi illegalmente tra il docente e alla componente genitoriale già in prima istanza, ovvero a creare i presupposti che porteranno a squalificare la professionalità del docente. Tutto è quindi possibile, come accorgersi dopo 25 anni di una carriera ordinaria, ovvero di scoprire che un tale docente non ha una adeguata professionalità. Mentre, il docente coinvolto sa di essere inquisito, sia pure in modo informale, di fatto e suo malgrado, senza che ha potuto spiegare alcunché alla componente genitoriale anonima e comprende che il dirigente Scolastico sta mettendo da parte tutta una serie di documenti (in segreto) per meglio compromettere la sua onorabilità in futuro. Questa consapevolezza di doversi trovare a lottare contro “mulini a vento”, sono di fatto una potente inibizione della libertà di insegnamento e conseguentemente una riduzione delle potenzialità educative e didattiche che il docente può offrire ai discenti. A tale proposito non può essere dimenticata la lezione che lo scrivente ha fatto all’inizio dell’anno scolastico, circa lo strumento ebraico dello Shofar, strumento che da lui è stato suonato in classe, perché sia in Presidenza che in Curia, tale sacro strumento della religione ebraica è diventato un volgare “corno”. Ma questo clima diffamatorio spesso può essere causato, anche soltanto da un pettegolare di corridoio di docenti con alcuni alunni dalla cattiva coscienza. Tale pettegolare, sempre vilmente posto in essere alle spalle del docente interessato, che mai ha dimostrato di essersi sottratto ad alcun confronto, viene giustificato con motivazioni di riservatezza, utilizzando la scusa della discrezione, ma la realtà è che questo pettegolare poi finisce sempre in Presidenza senza discrezione ed all’insaputa del docente interessato. 4. in realtà, la sua comunicazione Prot. n° 2352/C1, del 27/03/2013. non chiarisce quando, la S.V. abbia interloquito con la prima meccanici, (ovvero, prima del 25/03/2013, a motivo delle mie lamentele circa il suo disinteresse, riferitomi da alunni e docenti ed esternato nella mia comunicazione protocollo 2225/C1), in relazione all’evento criminoso realizzatosi il 12-03-2013, che ha visto il furto del Registro di Classe. Mentre di tale circostanza sia stato tempestivamente e dettagliatamente dichiarato ogni particolare, dalla prima delle mie due dichiarazioni (la seconda dichiarazione più generica, fu richiesta dalla S.V. dietro gli auspici della Collaboratrice Prof. ****, perché una generica dichiarazione sarebbe stata più idonea dal punto di vista formale alla mia difesa…, ma forse, una dichiarazione generica sarebbe stata più utile alla Presidenza al fine di poter inviare a me una riservata, che invece, sarebbe stata resa inutile da una dichiarazione già dettagliata? Tuttavia, già nella mia prima comunicazione si evidenziò tempestivamente, come il registro di classe era stato custodito con cura sotto un voluminoso faldone (come a dire, che era stato riposto con cura in una mia borsa), ed è questa più che solerte custodia, che non ha reso immediatamente consapevole lo scrivente, della sparizione del registro di classe. Tanto premesso, si deve considerare oggettivamente, come le mie istanze di Prot.2225/C1 del 25/03/2013, non siano state accolte. 5. Mi rattrista il suo invito di essere stato richiamato ad un confronto leale e sincero con la Presidenza e i suoi collaboratori, come se tutta la realtà non fosse andata in una direzione opposta al suo dire, come dimostra anche la mia presente comunicazione. Ma è proprio questa mia dichiarazione a farle comprendere come la S.V., ha utilizzato contro di me nel modo peggiore la sua autorità, perché dove sussistono dei limiti Istituzionali, questi devono essere osservati ed affrontati con rigore culturale, con lo spirito di comunità, solidarietà, comunione, e condivisione responsabile dei rischi di particolare entità, come è il caso in questione, e non con la smania di trovare la vittima di turno necessariamente. Inoltre, deve essere sfatata l’idea che lo scrivente sia un docente “morbido”, dal momento che il controllo disciplinare e didattico che lo scrivente ottiene nella numerosissima e problematica Prima sezione A, è più efficace di quello che la stessa Professoressa ****, può ottenere e come la stessa collaboratrice della Presidenza mi ha dichiarato. 6. A riprova della serenità del mio atteggiamento che è sempre stato di collaborazione e di come la mia azione non è mai stata subordinata da una qualche forma di meschina rivalsa per le offese ricevute, lo scrivente ha dimostrato generosità e supporto a tutte le politiche proposte dalla Presidenza nei Collegi dei docenti, perché convinto della positività di ogni forma di sperimentazione. [Seconda nota di interesse Istituzionale] Mi rammarico di come una certa ideologia scolastica stia distruggendo un patrimonio culturale immenso, in controtendenza con quello che ha scritto Benedetto Croce che è stato un filosofo, storico, politico, critico letterario e scrittore italiano, il principale ideologo del liberalismo novecentesco italiano; e fu anche un esponente di spicco dello storicismo, egli scrisse quale coscienza atea “Perché non possiamo non dirci “cristiani”, che è un breve saggio circa la identità storica e culturale che tale civiltà cristiana rappresenta nella identità del nostro popolo in modo fondante. Così esiste un patrimonio laico culturale cristiano universale indipendente che è separato dal cammino religioso della Chiesa Cattolica e che rappresenta i valori più nobili del nostro popolo, visti nella sua totalità. Ma purtroppo proprio nel nostro Istituto a dispetto delle legge è stato rimosso il simbolo del Crocifisso dalle aule ed anche il Presepe a Natale viene scoraggiato, per una malcelata sensibilità nei confronti del diverso e per un errato concetto della laicità, ecco perché in senso più ampio, poi noi non dobbiamo meravigliarci se stiamo subendo una deriva generalizzata circa la mancanza di importanti valori morali e la colonizzazione di Halloween e di tutti i disvalori che i simboli della morte stanno introducendo. 7. Tanto premesso, il mio desidero non è quello di “perdermi” in sterili contese per pensare al mio utile contingente, ma è quello di aiutare le nostre Istituzioni Scolastiche, a riflettere su tutte le anomalie (di cui la nostra situazione è soltanto un prototipo di altre situazioni ugualmente diffuse su tutto il territorio nazionale, ovvero la coscienza “criminale” che alcune scolaresche possono mettere in atto contro se stesse e contro alcuni docenti che hanno un impatto minoritario circa la gestione oraria della classe stessa, ovvero tutte le anomalie che questa nostra vicenda ha evidenziato, perché al di la delle attribuzioni di responsabilità a livello individuale (questione per me poco esaltante), è il Sistema Scuola nel suo insieme che deve riflettere, a come possa meglio affrontare questa sua nuova sfida che è in realtà una nuova emergenza sociale, affinché, altre vittime innocenti sia di alunni che docenti non possano più essere le vittime della più pericolosa forma di bullismo, che le nostre Istituzioni hanno imparato a conoscere, ma siano tutelate nella loro integrità psicofisica. 8. In particolare, io ricordo la vicenda di una docente supplente nella provincia di Lecce, che era seduta alla cattedra terrorizzata, mentre alunni infilavano la mano dietro la sua spalla nei pantaloni, e poi postavano su youtube tale video. Ovviamente, il nostro sistema istituzionale ha risolto tale problematica non considerando quel fenomeno criminale opportunamente, ma ha ritenuto di risolvere il problema licenziando la docente “incapace”. Mentre in realtà tale docente secondo me poteva essere la vera parte lesa all’interno di una situazione globalmente criminale, che poteva sussistere proprio a motivo della inadeguatezza della istituzione scuola nel suo insieme, di Istituzioni Scolastiche che come risposta hanno potuto offrire soltanto la propria ipocrisia. Anche lo scrivente ricorda una sua molto difficile situazione in una quarta all’ITIS di ***** e nonostante il loro numero di circa 30 alunni, grazie alla collaborazione di alcuni alunni lui è riuscito a fare le lezioni di religione, le verifiche dei quaderni di religioni degli alunni stessi, riuscendo a condurre in modo molto produttivo tale situazione. tuttavia nella stessa ITIS di ****, in una quinta di circa 15 alunni, lo scrivente ha dovuto subire gravi atti di bullismo e di umiliazioni perché anche in quel caso è stato facile per gli alunni far subire al solo Docente di Religione tutte le loro frustrazioni istituzionali, ed anche in quel caso tali abusi sono stati resi possibili dalla “gestione” di una Dirigenza Scolastica che era deliberatamente lontana dalle problematiche della classe, e che certamente avrebbe individuato eventuali disfunzioni, soltanto come una mancanza di autorevolezza del singolo docente, dal momento che tutto il Consiglio di Classe non ha rilevato le stesse condizioni di criticità. Pertanto è da condannare quella mentalità che vede le difficoltà educative e didattiche, riscontrate in una particolare ora di lezione, soltanto come una responsabilità individuale, che guarda caso quasi sempre vede coinvolto in più gravose problematiche il docente supplente o di ore minoritarie. Mentre quasi sempre, dietro tutte queste situazioni c’è sempre la tolleranza di un rendimento scolastico al minimo, per la impossibilità di poter far sussistere una tale classe al di fuori di tale permissivismo sia didattico che educativo (condizione sempre dichiarata, anche formalmente, in riferimento a tutte le classi con una tipologia simile alle nostre classi settore meccanici). Certo questa condizione di permissivismo crea una condizione di normalità apparente, nell’insegnamento di docenti a maggiore impatto orario, ma è sempre comunque un equilibrio precario che può facilmente rompersi sotto l’impulso di fragili fattori. 9. [Terza nota di interesse Istituzionale] Illuminante, a tale proposito è stato il corso di formazione svoltosi giovedì 11 Aprile alle ore 16,00 nel nostro Istituto con il consulto dell’Emerito ex-Presidente del Tribunale dei minori il Chiarissimo Dottor ******, il quale unicamente ha saputo indicare la soluzione di casi simili al nostro, ovvero ha evidenziato proprio lui dall’esterno della Istituzione Scuola, come certe problematiche criminali non possano essere affrontate adeguatamente senza il supporto degli assistenti sociali del tribunale. Ma è proprio per questa realtà di impotenza della istituzioni, che molti Dirigenti Scolastici ipocritamente preferiscono non “sporcarsi le mani” in situazioni fortemente compromissorie e quindi preferiscono scaricare ogni responsabilità sulla presunta mancata professionalità del docente incapace, il quale manca certamente di autorevolezza, come disse a me la ottima Prof.ssa Avvocato *****, ma prima che a lei capitasse il suo incidente del giovedì 11 Aprile. Anche se vincere parzialmente l’atteggiamento oppositivo della classe non è sempre indice di professionalità e ne tanto meno è indice di riuscire a creare condizioni virtuose in tali discenti. Ecco perché, un diverso atteggiamento del dirigente Scolastico come il supporto dai servizi sociali del Tribunale, sono indispensabili per la tutela della incolumità di tutti gli operatori e per l’espletamento ordinario delle funzioni che la società civile si aspetta dalla Scuola. Alcune coscienze criminali dei minori a noi affidate hanno bisogno di essere supportate degli assistenti sociali, in sinergia con i servizi di prevenzione del Tribunale dei minori, perché non debba mai esistere un docente che possa diventare; prima la vittima della logica del “branco classe”, per trovarsi poi ad essere anche la vittima del “branco” più grande che è la nostra Istituzione Scolastica, perché in questo caso il docente in questione non ha strumenti che lo possano tutelare. Non debba mai più avvenire che qualche docente, o qualche discente possa diventare, la vittima espiatoria di turno, di quei limiti istituzioni che vengono aggravati PENALMENTE da viltà del Dirigente Scolastico, che attende dietro la scrivania la consumazione del crimine, per finire di completare quel lavoro demolitorio che la “classe branco” ha iniziato a fare. Infatti, la apparente normalità della classe indica immediatamente come colpevole colui che non ha saputo essere adeguatamente “autorevole”. Tanto più grave è questo atteggiamento, quando è la Istituzione stessa a diventare il prolungamento di quella logica mafiosa del più forte, che è il riflesso del linguaggio di quella parte più deviata della nostra società, cioè, l’unico linguaggio della violenza che è il linguaggio delle associazioni criminali. 10. Quello che io cerco di dimostrare adesso e che la Istituzionale, anche nel suo atteggiamento migliore, in queste situazioni, non è sempre in grado di attivarsi a favore di tutti i docenti in ugual misura, perché non tutti i docenti hanno gli stessi requisiti di monte ore, o la stessa valenza disciplinare. E poiché per impedire la dispersione scolastica non si può optare per un atteggiamento che possa apparire troppo punitivo, questo da alcuni discenti il senso della propria impunibilità, come è stata la ridicola “punizione rieducativa” che il Consiglio di Classe ha potuto porre in essere, per stigmatizzare il furto del Registro di Classe. Tuttavia in generale, l’attuale intervento Istituzionale è sempre percepito da tali discenti non come un esito educativo, ma come “contenitivo”, “repressivo”, quindi, non solo raramente porterà a risultati concreti sul piano di atteggiamenti virtuosi interiorizzati, perché questa tipologia di alunni vivono nella logica dell’anti-società, dove è il furbo il modello vincente, ma paradossalmente porterà a forme di rivalsa della loro frustrazione ([Quarta nota di interesse Istituzionale] perché evidentemente non è il percorso scolastico ordinario quello che è più idoneo alla loro tipicità) contro gli elementi più vulneralizzabili della Istituzione Scuola. Così quando il gruppo classe decide di attivare misure oppositive contro l’anello più debole della catena istituzionale, lo fa sempre per esercitare forme di rivalsa contro quella frustrazione che la Istituzione ha fatto loro subire, oppure semplicemente per esprimere cattiveria in modo gratuito, come una loro espressione di potenza. La Prof.ssa ******, docente di Diritto nella Prima Meccanici era stata fatta il bersaglio di lancio di palle di carta, come lei stessa aveva evidenziato nelle note del Registro di Classe, che è stato distrutto dalla Prima Meccanici, poi, è seguita la sua lunghissima malattia, che ha visto il subentro della Prof.ssa ****, già eccellente supplente dell’anno scorso nella attuale Seconda Meccanici e quindi ben inserita tra quei docenti che sono maggiormente seguiti dal gruppo classe. Tuttavia, nella Seconda Meccanici, dove lo scrivente non ha mai vissuto momenti di particolare criticità, il giovedì 11 Aprile, alla sesta ora, la Prof.ssa Avvocato ****** accusava un malessere a motivo della insubordinazione degli alunni, diventava di colore pallido cadaverico e constatava come gli alunni invece di comprendere la sua situazione continuassero ad inveire contro di lei, “dimostrando cattiveria ed uno stato di isteria collettiva”, sono state le sue precise parole. Ecco che la Prof.ssa Avvocato ***** chiamava il marito, il quale allertava i carabinieri ed accompagnava la moglie al Pronto Soccorso. Bene hanno fatto i miei colleghi a non dare a me il numero di telefono della Prof.ssa Avvocato *****, perché anche lei non lo ha voluto dare. Questo deve dedursi, c’è sempre un modo Istituzionale per risolvere ogni problematica per una certa tipologia di docenti, ma poi un eventuale supplente, oppure un docente di sola materia facoltativa di Religione, oppure un docente che non è nella “grazie” della Presidenza, lui come farà a gestire una situazione del genere? 11. questo si deve concludere, ogni Dirigente Scolastico sa quando un docente è in condizione di particolare criticità con una classe, perché questo è un fenomeno sonoro che non può non essere udito, e quando lui ha bisogno di una momentaneo supporto di tutoraggio, da parte della Presidenza o dei collaboratori della Presidenza, perché possa incanalare, anche lui in modo minimale, come per tutti gli altri, quella situazione minimale di scolarizzazione, sia in riferimento al controllo disciplinare che didattico, che questa particolare tipologia di scolaresca necessita, al fine di scongiurare il porre in essere di sempre più gravi abusi ed eventi criminosi, e poiché, la scuola non ha le risorse per intervenire, ecco che è il Preside che dovrebbe farsi carico di questa azione di tutoraggio insieme agli assistenti sociali del tribunale, in tali particolari situazioni che esulano dalla normale amministrazione didattica di una scolaresca. Perché come si è compreso anche un Preside che non sia il vigliacco che siede dietro la sua cattedra, cioè, ovvero un Preside coraggioso non avrebbe reali possibilità, per impedire la sua azione di forza con inevitabili procedimenti disciplinari, che possano inevitabilmente implementare quella dispersione scolastica che si tenta di evitare, anche nei confronti di alunni più “deboli”, che in tale classe non potrebbero sussistere. Fatta richiesta di copia del Verbale del consiglio di Classe della PRIMA Meccanici del 06-maggio 2013. Tanto deve dirsi in premessa [dati sottoposti ad univoca ed inequivocabile interpretazione] la Classe che inizialmente era composta di circa 27 alunni, ad oggi è composta di circa 14 alunni dei quali il 50% circa non può essere scrutinato per l’esubero dei giorni di assenza e dal mio punto di vista soltanto la inefficacia della nostra azione nei confronti dei leader negati ha potuto permettere una tale situazione, [dati sottoposti ad univoca ed inequivocabile interpretazione] ecco perché lo scrivente chiede la tutela degli assistenti sociali del Tribunale a favore di quattro alunni come specificato nel Corso di Aggiornamento, cioè in favore di quei soggetti che possono avere un potenziale negativo nei confronti della società stessa. i documenti impugnati dal Dirigente Scolastico contro la mia professionalità sono illeciti 1. Nessun articolo di legge specifica nella fattispecie la tipologia del reato a me ascritto; 2. Gli alunni al suono della campana sono fuggiti dalla classe, palesando una loro ulteriore infrazione e non dando al docente la possibilità di poter interloquire con i discenti circa la mancanza del Registro di Classe. 3. Pertanto, lo scrivente non può essere ritenuto il responsabile di comportamenti illeciti compiuti da terzi. Da esperire durante il tentativo di conciliazione presso l’Ufficio Scolastico Provinciale. Bari 07-maggio-2013. è troppo facile dichiarare “incapace” un docente, ma assai più difficile è percorrere nuove strade, che vedano un reale ed efficace intervento educativo nei confronti di minori che sono portatori di estreme povertà, e che rivelano un potenziale sociale molto negativo e preoccupante. Premesso che se il mio Dirigente Scolastico non avesse dimostrato un atteggiamento palesemente ostile nei miei confronti, non una sola sillaba sarebbe pervenuta a questa Direzione Provinciale. Il martedì, 09 aprile 2013 alla sesta ora di Religione gli alunni A e B si sono rifiutati di consegnare i loro cellulari al docente, nonostante la sua rassicurazione che li avrebbe loro restituiti alla fine dell’ora di lezione, entrambi hanno deciso di non offrire alcun tipo di collaborazione didattica. L’alunno C ha giocato a videogame per tutta l’ora, mentre l’alunno D non soltanto ha mentito circa la sua identità al docente di Religione ma ha anche ascoltato la musica a suo piacimento ad alto volume. ==== Al Dirigente Scolastico ** Oggetto comunicazioni disciplinari classe prima meccanici. In considerazione della delibera del Consiglio Classe di applicare il voto di “sei” in condotta a tutti gli alunni presenti alla sesta ora di martedì 16 marzo (SECONDO TRIMESTRE), lo Scrivente dichiara che in riferimento ai soli alunni A e B trattasi di una grave ingiustizia, perché durante gli ultimi minuti di lezione mentre il “registro di classe” veniva scippato da dove era stato adeguatamente custodito, ovvero sotto i voluminosi sussidi, 18 registri, libri di testo, Bibbie e dispense, che il docente di religione è costretto a portare in classe, in quanto gli alunni medesimi giungono sprovvisti di ogni materiale didattico. Pertanto, tra i banchi degli alunni, gli alunni A e B stavano continuando il dialogo educativo con il docente di Religione, mentre, si attendevano i minuti conclusivi dell’ora di lezione, e mentre, il registro di classe veniva sottratto. Tali alunni hanno dimostrato di essere sommamente virtuosi dal momento che in dissonanza con “branco classe” che ha deciso di non accordare un soddisfacente livello di collaborazione al docente di religione, i due alunni sopra citati hanno avuto invece un positivo atteggiamento, e la cura del loro quaderno di religione, ed hanno sempre mantenuto un comportamento responsabile, tanto che sono stati gli unici che hanno potuto meritare una valutazione positiva in Religione nel secondo trimestre. Purtroppo, sabato 16 e sabato 23 marzo, alla quarta ora (11,10-12,10) mentre lo scrivente era intento al suo aggiornamento nell’aula computer dedicata ai docenti, dal laboratorio di informatica attiguo, lo scrivente raccoglieva lazzi insulti e pugni contro la porta della sua aula e contro il muro, sempre da alunni della prima Meccanici, mentre era in servizio la prof.ssa (*) che è testimone di questi eventi di bullismo, subiti dalla mia persona. In particolare il 16 marzo un alunno sferra un pugno, di inaudita potenza contro la porta dell’aula informatica dei docenti, e lo scrivente, prontamente, si reca nell’aula laboratorio di informatica, mentre la collega prof.ssa ***** si rivolge all’alunno ****** che era l’unico che era rientrato prontamente nell’aula. Nell’ora successiva, alla quinta ora, alla presenza del prof. *****, lo scrivente cerca di ottenere una consapevolezza dell’alunno ******, il quale lamenta, esplodendo con tutta la sua ira, la sua innocenza con una volgarità e violenza verbale estreme. Poiché, questi atti di bullismo, si sono resi estremamente inquietanti, proprio dopo l’evento di sottrazione del Registro di Classe”, e poiché, lo stresso gruppo classe ha esternato la sua meraviglia, di non avere visto un intervento del Dirigente Scolastico, che era atteso a stigmatizzare l’episodio della sottrazione del registro di classe, ecco che, nelle loro erronee coscienze si è insinuata la convinzione della loro impunibilità, come anche, della impotenza e della debolezza della Istituzione Scolastica nei loro confronti, e di conseguenza si sono sentiti spinti a reiterare comportamenti erronei sempre più gravi. Classe Prima Meccanici, nota disciplinare alunno *. “l’alunno * è fuori dell’aula e manca anche la sua cartella”. Dichiara lo scrivente Prof. **** *** alla sesta ora del 16-04-2013 nella Classe Prima Meccanici, 1. Tutta la classe ha coperto la fuga dal nostro Istituto dell’alunno , dichiarandolo al bagno e simulando al suo banco la cartella scolastica di altro alunno. 2. Lo stesso alunno alla presenza della Prof.ssa affermò a proposito del furto del Registro di Classe “peggio per lui, che se lo è lasciato rubare!”. 3. All’ingresso dell’Istituto, tre giorni dopo la sparizione del Registro di Classe, lo stesso alunno invitava il docente di Religione a frugare nel bidone della spazzatura, ben sapendo che lo stesso registro era stato bruciato(secondo indiscrezioni) il giorno stesso della sua sparizione. ====== Prot. 3193/C1. oggetto relazione disciplinare 30 Aprile del Prof. ****. Richiesta di attivazione del servizio di prevenzione del tribunale come dichiarato nel corso di aggiornamento. Il giorno 30 Aprile la classe era composta dai sottoelencati 12 alunni. Gli unici alunni che come sempre sono stati corretti sono A e B, tutti gli altri oltre a non voler collaborare all’azione didattica hanno assunto comportamenti di bullismo verso il docente. All’inizio dell’ora l’alunno C non si limitava soltanto a giocare a carte, ma lo stesso esternava delle urla ad intermittenza, terminata la loro partita a carte, si sono resi indisponibili. All’inizio dell’ora richiesto il quaderno di religione all’alunno D, lo stesso ha rifiutato ogni forma di collaborazione dicendo “se non aprono il quaderno gli altri perché lo devo aprire io?” il suo comportamento di non collaborazione didattica è stato emulato quindi dalla classe. Altresì, molto grave è stato il suo comportamento dal punto di vista disciplinare, scorretto al punto da minacciare il docente, più volte, che se avesse ricevuto una nota disciplinare sul Registro di Classe sarebbe andato a protestare dal Preside, e poiché lo stesso reiterava tali minacce, ha ricevuto la formalizzazione della sua annotazione disciplinare sul registro di Classe. Lo stesso D ha tentato di appropriarsi del Registro di classe, dicendo che lo avrebbe strappato, poi ha preso il cellulare e simulava di chiamare i carabinieri per denunciale lo scrivente. Lo stesso D si impegnava a rilanciare il cassino, stando seduto vicino alla lavagna, quando lo stesso cassino veniva recuperato dal docente. Il cassino è stato lanciato attraverso la finestra in strada da E, purtroppo, lo stesso si è anche rifiutato di recuperare il cassino alla fine delle lezioni, infatti il cassino è stato recuperato dallo scrivente. F frequentemente si voltava di spalle e urlava in modo fortissimo, ma all’inizio dell’ora non solo rifiutava di spegnere il suo cellulare insieme a G, ma, lo stesso F utilizzava il suo cellulare a volume alto. Particolarmente riprovevole è stato il comportamento di H, I, L, M, N, ****, per avere utilizzato urla, lazzi e comportamenti fortemente lesivi del luogo scolastico in generale. Anche se il comportamento **** è stato scorretto tuttavia, lo stesso ha dimostrato di essere sensibile e preoccupato per i richiami del docente. ===== caro don ****, è così penoso per me muovermi tra avvocati, sindacati, ecc.. A questo punto lo scrivente poneva fine a questo gioco e poiché l’alunno F urlava in modo inspiegabile, il docente chiede allo stesso “perché gridi?” ponendo la sua mano affettuosamente sulla spalla. Ma l’alunno F protesta in dialetto dicendo “toglimi le mani di dosso” e si alza in modo minaccioso come a simulare una aggressione fisica contro il docente che pone in essere urlando con tutta la sua forza, ad una distanza di quindici centimetri, al suo orecchio destro che rimane stordito. 5. Per questa aggressione che l’alunno F ha posto in essere contro il docente, lo stesso docente ha accusato un senso di smarrimento e di momentanea perdita di equilibrio a cui ha fatto seguito una emicrania.
