No political opposition of any kind was tolerated. According to the statements received, anyone who expresses but an opinion contrary to the position of the North Korean ruling party, the Korean Workers Party, is subjected to serious punishments, often shared by family members.

Domestic media continue to be heavily censored and access to international media remains limited.

Any unauthorized assembly or association is considered a public disorder and, as such, liable to punishment. Freedom of religion, although guaranteed by the Constitution, is sharply limited in practice. Serious incidents of repression, including incarceration, torture and execution, of individuals engaged in public and private religious activities were reported. It was reported by multiple sources that many Christians were held captive in labor camps, where they were reportedly subjected to torture and suffered from starvation.

Torture and ill-treatment
According to unconfirmed reports, torture and ill-treatment are widespread in prisons and labor camps. Conditions are reportedly extremely harsh.

Refugees
Many North Koreans continued to cross the border into China. At least 100 North Koreans have been allowed to leave China after seeking asylum in diplomatic facilities and foreign schools until arriving in South Korea via third countries.

Hundreds of others have reportedly been arrested in China and forced to return to North Korea. It is not known precisely what happened to them after returning to North Korea, but several sources reported that they were often subjected to lengthy interrogations and torture. Some were reportedly jailed or sent to labor camps.

Food shortage
North Korea continues to rely on international aid to feed its population. According to a study carried out by the FAO (Food and Agricultural Organization), over 13 million people suffer from malnutrition. In October and November, a drastic reduction in donations for emergency operations in North Korea caused the WFP (World Food Programme) to stop distributing cereals to three million women, children and elderly people in the western and southern provinces , already relatively richer. There were fears that another 1.5 million North Koreans in the poorer east would be deprived of winter rations if the situation continued.

The government of the Democratic People’s Republic of Korea (North Korea) continued to refuse access to independent human rights monitors. Incidents of repression of fundamental freedoms, mistreatment in prison camps, public executions and religious repression continue to be reported. Food shortages persist and there are fears that economic reforms could negatively affect the living conditions of the poorest and most vulnerable classes.

Context
Throughout the year, relations between North Korea and South Korea (Republic of Korea) have been volatile. In June, a serious naval duel took place in the West Sea in which five South Korean sailors and an unknown number of North Koreans were killed. An unprecedented apology from the North Korean government led to inter-ministerial talks in Seoul, South Korea, in July and in Pyongyang, the North Korean capital, in October. In May and September, separated families were able to reunite and an agreement was reached on a rail and road connection between the two countries. North Korea participated as a separate state in the Asian Games held in Busan, South Korea, in September.

During a visit by Japanese Prime Minister Koizumi Junichiro in September, the Japanese delegation apologized for the damage and suffering inflicted on Korea by colonial rule in the past and offered economic cooperation including humanitarian aid. North Korea admitted to the kidnapping of 13 Japanese citizens in the 1970s and 1980s, eight of whom were dead. The five survivors were later allowed to visit Japan. Talks on normalizing relations between the two countries began in October, but were suspended when the Japanese government insisted that the five abducted Japanese visiting Japan could remain there to be joined by their family members still in North Korea.

In September, the US Deputy Secretary of State for East Asia and the Pacific was the highest-ranking US official in the Bush administration to visit Pyongyang. During the talks, the North Korean government admitted to having a plutonium enrichment program, which subsequently soured relations with both neighboring countries and the United States.

Economic reforms were launched in July. There were fears that some of the reforms could lead to further impoverishment of the most vulnerable sectors of society, including women and children. The North Korean currency has suffered a devaluation and food prices have increased dramatically. The gradual abolition of food rationing systems and housing subsidies was announced. For the first time since 1953, the year in which the government imposed collective agriculture, a family-run agricultural system was introduced on a trial basis.

Among other measures, the government established a special administrative area in Sinuiju, a town near the border with China, in September. Local authorities were granted semi-autonomy, particularly for economic matters.

Refusal of access
Limitations remain in the circulation of information and access to the country. Denial of access to AI and other human rights monitors hampered investigations into the human rights situation, although serious violations, including executions, torture, detention of political prisoners and inhuman prison conditions, were still reported.

Executions
Reports of public executions carried out in recent years have continued. These reports contradict statements made in July 2001 by North Korean officials to the United Nations Commission on Human Rights, according to which the last public execution took place in 1992.

Public executions were reportedly carried out in places where large crowds gathered, with advance notice given to schools, businesses and farms. Some prisoners were reported to have been “executed” in front of their families. Executions were carried out by hanging or shooting.

was gang-raped as punishment for her younger brother’s alleged relationship with a woman belonging to a tribe considered to be of a higher caste according to the tribal hierarchy scale. After a public outcry, the police took note of the incident and registered a complaint. The alleged rapists and council members were tried by an anti-terrorism court. During the trial, it was learned that the victim’s younger brother had been sodomized by tribesmen who made up the story of his illicit relationship. In August six men, including two council members, were sentenced to death; eight others were acquitted. Those sentenced to death appealed against their sentences, while the State appealed against the acquittal of the others. Both appeals were still pending at the end of the year.

In November a council of elders in Manjhan, Sindh province, ordered a man who was unable to pay his debts to hand over his ten-year-old daughter as a bride as alternative payment. Her daughter had lived with her parents until puberty. The little girl was reportedly kidnapped and later raped by her husband, a 40-year-old man. The rape was confirmed by a doctor who examined the little girl. A complaint was filed with the police, but village elders denied any wrongdoing.

The application of the law providing compensation to the families of murder victims in lieu of criminal proceedings has led to abuses against women.

*In June, a few days before the scheduled execution of four men for murder, a council of elders reached a compromise whereby they would pay compensation to eight young women and money to the victims’ families in exchange for dropping the charges against the four guilty parties. Following public outcry, the deal was rejected. A July directive from Punjab’s law ministry that the practice of handing over women as compensation to victims was illegal was not taken into account. Similarly, the Peshawar High Court’s 2000 directive that courts should not accept such compromises has been ignored.

Abuses dictated by the blasphemy law
Several men were sentenced to death for blasphemy. Others accused for the same reason have been killed, some in circumstances that suggest official complicity or condescension in the killings.

*Anwar Kenneth, a Catholic who proclaimed himself a prophet, was sentenced to death in July. The state of his mental health was not taken into account during the trial.

*In June an inmate at Kot Lakpat prison, Yousuf Ali, was shot and killed by a cellmate. When he was killed, his appeal against the blasphemy conviction and the subsequent death sentence, imposed two years earlier, was awaiting trial. Punjab governor Khalid Maqbool held prison staff responsible and ordered an investigation, but no other actions were reported.

In July, Zahid Mahmood Akhtar was stoned to death by a mob after a Muslim priest called for his killing. Zahid Mahmood proclaimed himself a prophet of Islam, and was charged with blasphemy, but was later released on bail in 1997 by a court, on the grounds of his mental illness. In the two weeks following the stoning, the police took no action, after which they arrested several suspects.

Abuse against minors
The government has failed to ensure that practitioners in the criminal justice system comply with the provisions of the Juvenile Justice System Ordinance 2000. Children continue to be brought before the courts in handcuffs and tried by judges not qualified to conduct cases of minors.

Children also continue to be sentenced to death, contrary to national and international law. In December 2001, President Musharraf announced that all juveniles sentenced to death before July 2000, the date on which the death penalty for juveniles was banned, would have their sentences commuted. Nonetheless, the implementation of this presidential decree has not been finalized.

*In August, two boys aged 14 and 15, arrested on suspicion of theft, were brought in handcuffs before a magistrate. Although he did not have the necessary authority to conduct the case, he confirmed their custody, without noting the fact that they had been handcuffed.

Atif Zaman, 16, was sentenced to death for murder in July by an anti-terrorism court. While the discussion regarding the jurisdiction or otherwise that the Anti-Terrorism Court should have over minors was underway, a discussion presented to the High Court, an appeal was lodged on his case. At the end of the year, the matter had not yet been resolved, and Atif Zaman remained in prison.

Muhammad Ameen was sentenced to death in January 2000 for a murder committed in 1998, when he was 16 years old. In September 2000 his appeal was rejected by the High Court. In March the Supreme Court refused to hear his appeal. A petition to the Supreme Court was still pending at the end of the year, and Muhammad Ameen remained on death row in Adiala Prison, Rawalpindi.

Woman rights
Women and girls continued to be victims of abuse within the family, in the community and in state custody. For these abuses, a condition of impunity persists. Hundreds of women have been killed following so-called crimes of honor. Some private initiatives have been announced. For example, in March the chief of the Leghari tribe said that honor killing should no longer be allowed. However, the state has taken no action to prohibit this type of practice and ensure that those responsible are brought to justice. The qisas and diyat laws relating to murder remained unchanged. These laws allow criminal prosecution only if the victim’s family is compliant. In the case of honor crimes, this often does not happen, which favors a persistent state of impunity. The police failed to respond adequately to the abuse of women.

Razina was killed in July 1999 by her cousin, who had considered her decision to marry freely a shame for his family. Razima’s father agreed to the prosecution, and in April the culprit was handed over to the Peshawar High Court.

Human rights abuses committed in the context of the government’s continued support for the US-led war on terrorism include the arbitrary detention of hundreds of people suspected of being linked to terrorist organizations, and their transfer into the custody of US officials . Systematic human rights violations also persist, including torture, deaths in custody and extrajudicial killings. At least 140 people were sentenced to death and eight sentences were carried out.

Context
A presidential order in January amended the Anti-Terrorism Law, which allows military officers to serve on the jury in trials for terrorist crimes.

In April a referendum extended President Musharraf’s term in office for another five years. The elections were characterized by complaints of irregularities and a low voter turnout.

In August the College for the regulatory framework reinstated article 58(2b) of the Constitution, which allows the President to dissolve parliament and establish a National Security Council, a consultative body on national security, made up of military and civilian officials .

In August the federal government passed the Human Trafficking Prevention and Control Ordinance. The National Commission for the Status of Women announced its willingness to review discriminatory laws, but had not produced any documents by the end of the year.

The minimum criteria that potential parliamentary candidates must meet changed just before the general election in October, resulting in many former politicians being excluded from the electoral competition. Seats have been reserved for women at all federal and provincial levels. However, female participation in the elections was not effectively ensured. Many village elders banned women from casting votes, and threatened to fine men who allowed their women to vote. In some regions less than ten percent of women with the right to vote showed up to vote.

The elections produced a parliament without a majority. For the first time, Islamist parties formed an alliance and became the third major bloc in the National Assembly. In November Mir Zafarullah Khan Jamali replaced Pervez Musharraf as head of government.

Arbitrary detentions and transfers of persons to U.S. custody
In January, four religious groups were banned while thousands of Islamists were arrested and held under administrative detention. They were subsequently released after a few days or weeks.

More than 400 people have been arbitrarily detained as a result of the US-led war on terrorism. The detainees were handed over to US officials without adequate human rights protection measures, thus violating local extradition law and violating the international principle of non-refoulement. Among them were Pakistanis, Afghans and people from the Middle East.

*Moazzem Begg holds dual citizenship, both British and Pakistani. He had run a school in Afghanistan, but in October 2001 he went to Islamabad with his family after the military actions began. In February he was forced into the trunk of a car and taken away by unknown persons. In April his father, based in the UK, received a letter from his son through the International Committee of the Red Cross (ICRC), saying he was in the custody of US forces in Afghanistan. According to the information received, at the end of the year he was still in detention, without charge or trial, under strict conditions of custody.

Lack of protection for minorities
The State continues to ignore abuses inflicted by individuals or groups against members of minorities. At least 40 members of the Shiite community, mainly doctors and other professionals, and around 65 Westerners and Christians were victims of premeditated murders. Preventive or protective measures proved to be non-existent or inadequate, and investigations into the killings were undertaken only following international pressure.

and, they were attending the trial. During a break, the defendant was escorted to the cell. As people were leaving the court, a loud explosion was heard, caused by shelling by Israeli helicopters. During the confusion, several gunmen shot Abd al-Hay Diab Sababa in his cell, killing him. No action was taken against those responsible.

United Nations
In October, the UN Committee on the Rights of the Child recommended that non-state actors establish and enforce strict recruitment rules for military and other personnel in order to fully respect children’s rights in accordance with the principles set out in the UN Convention on Children. and as established by international humanitarian law. It also recommended preventing the use or targeting of children in armed conflict and fully complying with Article 38 of the Convention and as far as possible with the Optional Protocol on the involvement of children in armed conflict.

aided by the Palestinian general intelligence services. On June 3, the Palestinian High Court of Justice in Gaza ordered his immediate release since he had never been charged or brought before a judge. However, the following day, the Palestinian cabinet, while expressing respect for the court’s decision, decided that Ahmed Saadat should not be released due to Israeli threats to assassinate him. The other four, Hamdi Qaran, Basel al-Asmar, Majdi al-Rimawi and Ahed Abu Ghalma, were tried before a special field court, in unfair proceedings, and on 25 April were sentenced to prison terms of up to 18 years . The sixth man, Fuad Shubaki, was detained on suspicion of involvement in an arms shipment from Iran, but was never brought to trial. On 10 December the Palestinian High Court in Ramallah ordered his release but he was still detained at the end of the year.

Death penalty
Palestinian state security courts have sentenced at least 13 people to death following unfair and summary trials . Three of these, who were accused of ordinary crimes, were “executed”. Another person was killed by security forces, apparently while trying to escape from prison. Nine of the people sentenced to death were accused of treason and collaboration with the Israeli secret services. People sentenced to death do not have the right to appeal and can be “executed” when the sentence is ratified by the President of the PA. During the year, President Arafat did not ratify any death sentences against alleged collaborators.

Khaidar Ghanem, a 39-year-old former worker for the Israeli human rights group BTselem, was sentenced to death on October 28 by the State Security Court in Gaza. He had been accused of collaboration with the Israeli secret services. His trial would last two and a half hours and he was represented by a court-appointed lawyer. According to testimonies, Khaidar Ghanem was convicted mainly because of his admissions. During the trial he reportedly said that he was not aware that the information he had given to Israeli intelligence agents would be used to kill people.

*Faisal Ahmed Suleiman Abu Teilakh, 26, and Said al-Barrawi Mohammed al-Najjar, 29, were shot by firing squad in Gaza on June 6, just 24 hours after they were sentenced to death by the Security Court of State for raping and killing a seven-year-old girl. The trial did not meet minimum international standards for a fair trial. The trial, in fact, lasted only three hours and the court was not told that one of the defendants was mentally retarded. The case was heard at the State Security Court although the crimes committed should have been tried in an ordinary criminal court.

Illegal killings
Dozens of Palestinians suspected of collaborating with the Israeli secret services were illegally killed. Most of these killings appear to have been carried out by armed groups or individuals. Some appeared to be extrajudicial killings carried out by members of the Palestinian security forces. LAP never conducted any investigation into the killings and none of those responsible were brought to justice.

On March 14, Muhammad Dayfallah al-Khatib, suspected of collaboration, was killed by Palestinian gunmen apparently unrelated to Palestinian security forces. Muhammad Dayfallah al-Khatib was sentenced to death by the Supreme Court of State Security in Bethlehem on January 13, 2001 for treason and collaboration with Israel, at the end of an unfair trial that lasted only five hours. He and other prisoners had reportedly been moved to safe houses from a prison in Bethlehem that was later bombed by Israeli airstrikes.

Mundher al-Hafnawi and Hussein Abu al-Uyun were killed in Nablus on March 15 by armed Palestinians apparently unconnected to Palestinian security forces. The two had escaped from Nablus prison on March 9, after the gates of the prison complex were damaged by Israeli helicopter fire. Both were sentenced to death in 2001 following unfair trials for collaboration with Israel.

On July 14, Abd al-Hay Diab Sababa, 42, was killed by gunmen during his trial before the Palestinian State Security Court in Khan Yunis. He had been accused of collaborating with the Israeli security forces and of having provided information that facilitated the assassination by the IDF of four Hamas activists. Dozens of people were arrested for political reasons. Among these, alleged members of armed groups and people suspected of collaborating with the Israeli secret services. At least thirteen people were sentenced to death, three of these were “executed”. Most of the people sentenced to death were accused of collaboration with the Israeli secret services. Dozens of suspected collaborators were unlawfully killed by armed groups or individuals.

Context
The al-Aqsa intifada (uprising), which began on September 29, 2000, continued. More than 1,000 Palestinians have been killed by Israeli security forces, most of them illegally.

Palestinian members of armed groups attacked Israeli soldiers and civilians. They killed more than 415 Israelis, including approximately 180 Israeli civilians inside Israel and more than 80 Israeli civilians in the Occupied Territories, and injured thousands of other people. The deliberate targeting of civilians constitutes a crime against humanity (see also Israel and the Occupied Territories).

The main armed groups involved in the attacks were: the al-Aqsa Martyrs’ Brigades (a fringe of Fatah), the Izz al-Din al-Qassam Brigades (Hamas), Islamic Jihad and the Popular Front for the Liberation of Palestine (Pflp).

Administration of justice
President Yasser Arafat and other members of the Palestinian Authority (PA) have regularly condemned suicide bombings and othe r attacks and killings against Israelis, calling on Palestinian armed groups to put an end to them. However, in the vast majority of cases, those who ordered or planned such attacks were not brought to trial and there are no investigations in this regard. It remains unclear to what extent the PA could effectively exercise control over armed groups involved in attacks against Israelis. The Israeli army’s systematic bombing and raids of almost all PA infrastructure, including prisons and security installations, have reduced the PA’s ability and willingness to exercise control over armed groups and address the grave rights emergency. humans.

As a result of the destruction and targeting of PA prisons and detention centers by the Israeli Defense Forces (IDF), many prisoners have been transferred to temporary detention centers in unknown locations (so-called safe houses) for avoid bombings, incursions and murders of prisoners by the IDF. On several occasions, the PA released prisoners, or they escaped, while prisons or safe houses were attacked by the Israeli air force. On other occasions, prisoners were released while safe houses or prisons were attacked by groups of Palestinians. On at least one occasion, Israeli forces raided a Palestinian prison and released suspected collaborators. During the IDF incursions, files relating to detainees and possible defendants were also destroyed or taken from PA security installations and administrative buildings. Prolonged closures or curfews prevented or diminished the functioning of PA courts as judges, lawyers and witnesses could not move freely within the Occupied Territories.

Legislation
In May, President Arafat ratified the Basic Law, which was approved by the Palestinian Legislative Council in 1996. The Basic Law affirms the independence of the judiciary and recognizes the rights of all persons residing under the jurisdiction of the PA according to its provisions. contained in international human rights treaties including the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. The law went into effect in July.

Arbitrary detention and unfair trials
LAP arrested dozens of alleged members of Hamas, Islamic Jihad and other armed groups as well as people suspected of being collaborators of the Israeli secret services. Some remained in detention without charge or trial in PA prisons, detention centers, or safe houses. There were reports of torture and ill-treatmen t of detainees by various Palestinian security forces.

The Emir, al-Shaikh Hamad Ibn Khalifa Al-Thani, proclaimed the establishment of a government human rights commission and announced future constitutional changes with potential positive effects on the human rights situation. Nonetheless, the ways in which human rights are consistently violated have not changed and, following the September 11, 2001 attacks in the United States, have often been supported by policies adopted for global and regional security. One possible prisoner of conscience was sentenced to death, while another who had been detained since 2001 was released. The status of 39 political prisoners, some of them possible prisoners of conscience, who have been detained for several years, remained unchanged. Cases of ill-treatment were reported and new information emerged on past incidents of torture.

Context
In January, Qatar reported to the UN Security Council’s Committee on Counter-Terrorism the measures it had taken to combat terrorism. One of the measures elaborated in the report reported that the authorities are developing special bilateral cooperation agreements with certain States regarding extradition and the exchange of information on criminals…. The US State Department report, Patterns of Global Terrorism, released in May, found that Qatar worked closely with US authorities to arrest and investigate suspected terrorists. In its report to the Security Council, the Government of Qatar did not refer to the protection of human rights, nor did it reveal the identities of the people who had collaborated with the US authorities or what procedures were adopted in these cases. Worryingly, human rights standards have been ignored.

Najib al-Nuaimi, a lawyer and former justice minister, attempted to create a committee of lawyers to defend the right to seek justice for detainees at the US detention center in Guantánamo Bay, Cuba. He said he had obtained the assignment from some of the families of detainees from several Gulf states and that he had tried to obtain permission to visit the detainees, but that the US authorities had not granted him a visa. Among the prisoners are Jar Allah al-Murri, a citizen of Qatar, and Sami al-Haj, a Sudanese employee of the Qatari television station al-Jazeera, resident in the country.

AI has received a government response to the concerns expressed by the organization in the 2002 Report. The response highlights the changes initiated by the authorities in light of some concerns expressed by AI, but rejects others as inaccurate or defends its actions on legal grounds that AI considers do not comply with international human rights standards.

Possible prisoners of conscience
One possible prisoner of conscience was sentenced to death, while another, Luay Muhammad Abdullah, a US citizen of Palestinian origin, sentenced to two years, was released in January (see below).

*Firas Nassuh Salim Al-Majali, a 29-year-old Jordanian journalist who worked for Qatar National Television, was sentenced to death in October by the Grand Criminal Court in Doha. He had been found guilty, at the end of a clearly unfair trial, of spying for the Jordanian secret services (see below). In all likelihood he, the accused, was a victim of the deterioration of political relations between Jordan and Qatar. The crisis between the two states is due to various reasons, including a television report broadcast by the al-Jazeera television network in August, which criticized the Jordanian royal family and the country’s policy in the Middle East. The defendant lodged an appeal which was still pending at the end of the year.

*Thirty-nine political prisoners, some of them possible prisoners of conscience, who had been convicted in recent years following clearly unfair trials for the 1996 coup attempt, remained in prison. These included 19 prisoners whose life sentences had been upgraded to capital sentences by the Court of Appeal in May 2001. The other 20 had been sentenced to life imprisonment.

Torture
Ill-treatment was reported and new information emerged on cases of torture. During pre-trial detention, Firas Al-Majali (see above) was placed in prolonged solitary confinement and subjected to coercion in order to extract his confession. No investigation into the torture incidents of 2001 appears to have been started. Other people who reported being tortured included Luay Abdullah, a possible prisoner of conscience, who was released in January. He reported being beaten and suffering head injuries.

Death penalty

Rome Statute of the International Criminal Court: signed

Dozens of people were arrested during the year for political reasons, including Syrian exiles who had voluntarily returned and other people suspected of being members of unauthorized political groups. There has been an intensification of repression of human rights defenders and lawyers. Hundreds of political prisoners remained in prolonged detention without trial or following unfair sentences. Some were ill and despite this they were detained in very harsh conditions. Ten prisoners of conscience were sentenced to up to 10 years in prison following unfair trials before the Supreme State Security Court (SSSC) or the Criminal Court. Reports of torture and ill-treatment have decreased, but cases relating to previous years have not been investigated. At least two people died in detention.

Context
President Bashar al-Assad decided on an amnesty in June, in which he reduced by one third the prison sentences imposed on children aged seven to 18 convicted of criminal offences. It is unclear which crimes were covered by the amnesty and how many children benefited from it. Another amnesty in October covered people who had avoided military service or who had deserted.

In June the European Parliament approved a resolution on Syria, in which it expressed serious concern about the imprisonment of intellectuals and opposition figures. It called on the authorities to ensure that detainees were not tortured or ill-treated and to ratify and implement the United Nations Convention Against Torture.

Syrian opposition groups inside and outside the country intensified their peaceful activities during the year. In April, 137 former prisoners of conscience residing in Syria sent a memorandum to President al-Assad requesting that all former prisoners of conscience be reinstated in their previous jobs and urging the lifting of restrictions on them relating to work, movement and travel . In August, a conference promoted by al-Ikhwan al-Muslimun (Muslim Brotherhood) in London led to the adoption of the National Charter for Syria, containing principles that include respect for human rights, including those of women, and the rejection of any form of violence.

Human rights defenders
There was an increase in repression of human rights defenders and lawyers during the year. The two largest human rights groups, the Committee for the Defense of Human Rights and the Association for Human Rights in Syria (HRAS), continued to operate despite the absence of official authorization, government restrictions and detentions of their members.

*In April, the Damascus Bar Association (DBA) imposed arbitrary disciplinary action on human rights defender Haytham al-Maleh, a lawyer and director of the HRAS. He was suspended from practicing for three months after he expressed concern about the fairness of the trial of a client, prisoner of conscience Mamum al-Humsi (see below). During the year, Haytham al-Maleh was summoned several times by the security forces and the DBA for questioning regarding his involvement with the HRAS and his public statements on human rights in Syria. In June the DBA decided to prevent him from practicing his profession for three years and in September the deputy military prosecutor referred him, together with Qasub Ali al-Malla and three other men, to the Military Tribunal, on charges that included the distribution of the bulletin of Hras Teyyarat without a license and involvement in an organization (Hras) of an international nature without government permission.

*In April, lawyer Anwar al-Bunni was arbitrarily suspended from his practice for three months by the DBA in connection with the Mamun al-Humsi case. In June he was physically expelled from the SSSC, when he requested that the complaint of mistreatment of his client, the prisoner of conscience Aref Dalilah, be put on record and investigated. Woman rights While the debate on women’s rights has continued, the government has adopted measures that could represent a starting point for the elimination of this serious discrimination. The existing discrimination was highlighted in all its severity during a fire that broke out in March in a school in Mecca, in which 15 of the 800 girls hosted died while at least a dozen suffered serious injuries. The cause of these deaths could be attributed to the strict application by the Mutawaeen, the religious police, of the se* segregation policy. According to some eyewitnesses, the religious police prevented the girls from leaving the building because they were not adequately veiled and because there were no male relatives waiting for them. Nonetheless, torture continues to be reported while there is no news of compensation to the victims. Judicial corporal punishment, including mutilation, continues to be regularly carried out.

In March the poet Abdul Muhsin Musalam was reportedly arrested for writing a poem entitled The Corrupt on Earth, in which he criticized judges. The poem was published by the newspaper al-Madina. The editor of al-Madina was subsequently fired, apparently for allowing the poem to be published. Abdul Muhsin Musalam was detained for approximately 14 days before being released without charge or trial.

In April, 47-year-old professor Abdul Hamid al-Mubarak of King Feisal University in al-Ihsa was reportedly arrested in Dahran following protests against Israeli military attacks on Palestinians. According to the Okaz newspaper, the deputy Interior Minister stated that the professor’s detention was aimed at initiating legal action.

*In July, 28-year-old Said bin Said Zuair was arrested at Riyadh airport. It seems that he was about to leave for Qatar to be interviewed by al-Jazeera TV to make public the case of his father detained in Saudi prisons. His father Said bin Zuair, a government opponent and former dean of science at Imam Muhammad Ibn Saud University, was arrested in 1995 and has been detained without charge or trial since then. ***Torture in custody
Torture of suspects arrested during or in the past year was reported. Dozens of people, including women and children, arrested in April during demonstrations in support of the Palestinian intifada, were reportedly beaten. A former prisoner, a possible prisoner of conscience, released in March, said he was chained hand and foot, beaten and deprived of sleep. Lawyers for Alexander Mitchell and William Sampson (see below) claimed that their clients had suffered physical and psychological torture during their interrogation. No investigation was launched following these accusations.

***Flogging of minors
Regional authorities continued to urge police to use caning to punish boys suspected of committing immoral acts. Over the course of the year, numerous adolescents were victims of this practice.

*In August, fifteen boys were caned because they were accused of maintaining lewd behavior and annoying families in a park in Taif. According to a news article, the young people received 15 lashes each directly on the spot at the hands of the police immediately after the arrest.

***Flogging
Caning remains the most frequently applied corporal punishment, imposed by courts as both a principal and ancillary punishment.

*In February a woman was sentenced to 65 lashes in addition to a six-month prison sentence. She was charged with committing adultery with her sister’s husband despite her having told the court that she had been raped by her brother-in-law. The man in turn was sentenced to suffer 4,700 lashes and six years in prison.

***Mutilations
At least seven people, all foreign nationals, had their right hands amputated while one man reportedly had two teeth extracted as part of the qisas (punishment).

*In July in Mecca, Abdulrahman Ismail, an Egyptian citizen, and Shir Muhammad Ali Ahmad, an Afghan, both accused of theft, suffered amputation of their right hands.

*In May, Awda al-Zahrani, a Saudi citizen, reportedly had two teeth extracted as punishment for causing similar injuries during an argument. According to a news article, the extraction was carried out by a dentist.

Refugees
More than 5,000 Iraqi refugees from the 1991 Gulf War have spent their eleventh year in semi-detained conditions in the Rafha military camp, located in the northern desert on the border with Iraq. The government continued to deny them the opportunity to obtain asylum.

Death penalty
At least 48 death sentences were carried out. Twenty of these involved foreign citizens. Among Saudi citizens, three men were “executed” because they were accused of homosexuality. All 48 were convicted at the end of trials about which very little was learned. Due to the secrecy that surrounds the judicial system, it is not possible to know the exact number of people awaiting execution. Among those known to have been convicted are Siti Zainab, an Indonesian maid convicted of the murder of her employer in 1999, Alexander Mitchell, a British citizen, and William Sampson, a Canadian, both convicted of a serious bomb attack in Saudi Arabia in 2000. Their case would be subjected to scrutiny by the King who could grant pardon or confirm the execution.

Two Saudis sentenced to death have obtained pardons according to the qisas, which grants the victim’s relatives the right to decide on the life or death of the guilty. In December the King commuted the death sentences of 17 members of the Ismaili community to 10 years in prison. All 17, arrested together with dozens of others in April 2000 following protests by the Ismaili community of Najran against the closure of their mosque, are possible prisoners of conscience.

Serious violations of human rights continue to occur, accentuated by the government’s policy of fighting terrorism following the attacks of 11 September 2001. These violations are largely attributable to a non-transparent use of justice and the ban on political parties, trade unions and independent organizations for the protection of human rights. Hundreds of religious activists and opponents have been arrested, while for many of the people arrested in recent years, and still in prison, the reason justifying their arrest has not yet been made known. Women continue to be subject to serious discrimination. Torture and ill-treatment remain rampant. At least 48 people were “executed”. The more than 5,000 Iraqi refugees in Rafha camp continue to live in semi-detained conditions. Non-governmental human rights organizations did not have access to the country, while the concerns expressed by AI during the year attracted no response from the government.

Context
In response to the continuous and serious violations, the international community has monitored the human rights situation in the country while the Saudi government has promulgated laws that, if implemented, could have a positive impact on the matter.

In May, the UN Committee against Torture reviewed Saudi Arabia’s compliance with its obligations under the UN Convention against Torture, urging the government to adopt legislation to enforce the principles. by the Convention. In October, the United Nations Special Rapporteur on the independence of judges and lawyers visited the country for the first time. From a first observation he noted that the legal system is undergoing substantial changes, both from a structural and procedural point of view.

The government introduced a code of criminal procedure and a law regulating the legal profession. According to the Special Rapporteur, rules have been issued for the application of the criminal procedure code […] while work has begun for the registration of lawyers in a special register, an operation that the government intends to complete within the next five years. However, he noted that many of these new laws take a long time to actually implement. Prisoners of conscience and political prisoners
Hundreds of religious activists and opponents were arrested during the year, while the reason for the arrest of most of the detainees who have already been in prison for years has not yet been made known. About a dozen possible prisoners of conscience have been released, while for many others still in prison, the position has never been clarified. None of the detainees were able to avail themselves of legal assistance, nor were they notified of the reason for their arrest, while it is not known whether the right to receive family visits was guaranteed.

***Impunity
Torture victims who attempted to bring their complaints to court continued to face major obstacles. Because the detainees were frequently blindfolded, it was not possible to identify the torturers. Medical reports proving torture have often been destroyed and doctors who documented torture have been threatened. Intimidation of victims and witnesses and a general climate of fear have also contributed to maintaining impunity, as has the reluctance of prosecutors to investigate the behavior of members bri of the security forces. Statements extracted under torture were frequently accepted as evidence in trials, and judges often refused to investigate claims of torture.

The delay in bringing proceedings in a number of high-profile cases of torture has resulted in the failure to bring those responsible to justice. The defendants who were police officers did not show up at the hearings, in some cases their lawyers resigned or did not present the requested material in court.

Gülderen Baran was tortured in 1995 while she was in custody of the anti-terrorism section of the Istanbul police. Repeated suspension by her arms caused her to lose the ability to move both limbs. At the end of the trial she was sentenced to life imprisonment. Five police officers accused of torturing her were brought to court. Although a commissioner and an officer admitted during the trial that they had used force and beaten her, the case was closed on March 12 due to the expiration of the deadline. The officers on trial were not suspended from duty during the proceedings and, subsequently, one of them was promoted to the rank of chief superintendent.

*On 16 October, the ten police officers accused of torturing fifteen minors and a teacher in police custody in the city of Manisa in 1996 were sentenced to prison terms of between 5 and 11 years.

Maximum security prisons
Solitary confinement in maximum security prisons continued to be a topic of heated debate. The authorities continued to build a further 11 type F penitentiaries and to add new sections to the prisons already built in which the dormitories were replaced with small cells. Thousands of inmates in six existing F-type prisons have been held in prolonged solitary confinement or small group solitary confinement, treatment that may amount to cruel, inhuman or degrading treatment . Hunger strikes against F-type prisons continued and resulted in the deaths of 21 people during the year, bringing the total number of deaths resulting from the hunger strike to at least 57. Although in October the Minister of Justice removed the restriction on private interviews of detainees previously conditional on participation in training programs such meetings were limited to five hours a week, thus not meeting the recommendations of the European Committee for the Prevention of Torture. There have been several reports of mistreatment of prisoners in F-type prisons, but they have proved difficult to verify due to limited access to such facilities.

Minority rights
In September Turkey ratified the International Convention for the Elimination of All Forms of Racial Discrimination. Despite legislative reforms aimed at easing restrictions on the ability to publicly express Kurdish identity, observers have failed to note significant improvements in the practice. In August a legislative change allowed the introduction of language courses and radio-television broadcasts in languages traditionally used and spoken by Turkish citizens in daily life. However, a week after this change was approved, the Ministry of Education removed the leader of the Diyarbakýr teachers’ union from his post, apparently for having advocated broadcasting in the native language in a speech. No course of study in the Kurdish language has so far been approved by the authorities and thousands of people have been arrested for signing petitions demanding the right to be educated in Kurdish. Some of those arrested appear to have been tortured or mistreated. Some have been accused of supporting illegal armed organizations such as the PKK (Kurdistan Workers’ Party) or its subsidiary, Kadek. However, following the amendment to the law, it seems that some of those arrested have been released while the process for others is still ongoing.

Over the course of the year, several cases were opened against parents who tried to register their children with Kurdish names. *Abdullah Yaðan was sentenced in July to 45 months in prison by the Diyarbakýr State Security Court for playing Kurdish music to passengers in his minibus.

Torture and ill-treatment
Reports of torture continued to arrive, highlighting the growing use of methods that leave no visible marks on the body. Detainees continued to be subjected to treatments such as electric shocks, arm suspension, and falaka (beatings under the soles of the feet). Other regularly reported methods of torture and ill-treatment include severe beatings, sexual abuse, being hit with violent jets of pressurized cold water, being stripped naked during interrogations, death and rape threats, other psychological torture, sleep deprivation, food deprivation , of any drink and the prohibition to use the toilets. According to reports, arrested women and girls frequently suffered sexual abuse and were threatened with rape. Several women were raped.

Among the victims were people suspected of pro-Kurdish, Islamist or left-wing activities, or those who had requested education in the Kurdish language. Other people were arrested on suspicion of committing criminal offenses or simply for not obeying the orders of security forces officers. Suspects of theft or burglary – including many children – were regularly beaten while in detention.

*Hamdiye Aslan, a 37-year-old Kurdish mother of five, was stopped in March in Mardin, Kýzýltepe province and held for two days at the anti-terrorism section of the Mardin police. Hamdiye Aslan was held in Mardin Prison for almost three months until she was released pending trial. Medical reports confirmed her reports of torture. *On April 3, Tekin Demir was arrested together with his son in his home at 5 in the morning on suspicion of supporting an illegal organization. Both remained for two days at the anti-terrorism section of the Ankara police. According to information received, while in custody, Tekin Demir was kept blindfolded, stripped naked, given electric shocks, hit with jets of cold water, beaten and threatened, his hair and mustache were pulled out and his fingers were scalded with boiling water. The officers also stomped on his hands while he lay on the floor. Prolonged police custody and incommunicado detention
Following a constitutional amendment passed in October 2001, parliament enacted a law in February reducing the maximum period of initial police or gendarmerie custody to four days before arrestees are brought before a judge. Furthermore, the new law reduced the maximum duration of incommunicado detention from four days to 48 hours for detainees suspected of crimes that fall under the jurisdiction of the State Security Courts. However, these changes have not been able to end the widespread use of torture and ill-treatment, which mainly occurs in the first 24 hours of detention.

Legal reforms have led to the abolition of the death penalty for crimes committed in peacetime and to some amendments to laws limiting freedom of expression. However, many prisoners of conscience continued to face trials or be detained, especially for expressing opinions on the Kurdish question, on F-type maximum security prisons or for expressing Islamist-oriented opinions. Torture in police custody remained widespread and was carried out systematically in the anti-terrorism sections of police stations located in the south-east of the country. Those responsible for such acts were rarely brought to justice. Dozens of killings by members of law enforcement have been reported; some of these may be extrajudicial executions.

Context
The reforms to the legal system were introduced by the coalition government of Bülent Ecevit in order to meet the criteria necessary for accession to the European Union. The death penalty was definitively abolished in August with the exception of crimes committed in times of war or imminent threat of war. In February, March and August, parliament enacted three laws with the aim of adapting Turkish law to European human rights standards. Along with the abolition of the death penalty, the other reforms involved changes to prison regulations and amendments to laws used in the past to limit the right to freedom of expression. However, some of these legal changes have proven ambiguous and insufficient to address the human rights abuses they were supposedly designed to address. Furthermore, the changes were often not implemented in practice.

In March, Amnesty International was granted permission to open a branch in Turkey under the Associations Law.

In the south-east of the country, with a Kurdish majority, the state of emergency was lifted in two provinces in July and in the remaining two in November.

Early general elections were held in November after several ministers resigned from the coalition government made up of Prime Minister Bülent Ecevit’s Left Democratic Party (DSP), the Nationalist Action Party (MHP) and the Motherland Party (ANAP). . The Justice and Development Party (AK) was elected to government with an absolute majority. Of the other political parties, only the Republican People’s Party (CHP) won seats in parliament. AK Party deputy secretary Abdullah Gül was appointed prime minister. AK Party secretary Recep Tayyip Erdoðan, a former prisoner of conscience, was unable to run for parliament due to his previous conviction.

In December, the new government introduced a package of legal reforms targeting key human rights issues, including torture, impunity and freedom of expression.

Prisoners of conscience
Many people, including writers, journalists, trade unionists, local and national politicians, religious leaders and human rights activists, continued to be imprisoned or prosecuted for exercising their right to freedom of expression.

The new legal provisions narrowed the definitions of crimes punishable by law and, in some cases, reduced the maximum sentences that could be imposed, but their ambiguity was still a cause for concern. In several cases, after the approval of the new laws, sentences were revised or charges were dropped, however many prisoners of conscience remained in prison and political trials continued. Representatives of human rights organizations, political parties and trade unions who opposed solitary confinement in F-type prisons continued to be charged under Article 169 of the Criminal Code for complicity with illegal armed organizations, and many were considered prisoners of conscience.

to the children

One day, a large number of people gathered.

They came from different places and were quite different from each other.

There were men and women. Their skin, hair and eyes were different colors. Their bodies and faces had different shapes.

Some came from rich countries and some from poor countries. Some from warm places and some from cold places. Some came from Kingdoms, others from Republics. They spoke very different languages. They had different religions.

Some of the countries represented had just emerged from a terrible war that had destroyed many cities and killed huge numbers of people. Many people had lost their homes and their families.

Many had been injured or killed because of their religion, their race or their political ideas.

What brought those people together was the desire that there would be no more wars, that no one would be hurt anymore and that those who had not harmed others would no longer be punished.

So, they all wrote a document together.

In this document they attempted to make a list of the rights that every human being has and that everyone should respect.

This document was called the “Universal Declaration of Human Rights” and this is what it says:

Everyone is born free.

Everyone is born equal and with the same rights.

Everyone can think freely and understand what is happening around them.

Everyone should behave like brothers and sisters.

It doesn’t matter what race you are.

It doesn’t matter if you are a man or a woman.

It doesn’t matter what language you speak, what your religion is, what your political ideas are, what country you come from or who your family is.

It doesn’t matter if you are rich or poor.

It doesn’t matter what part of the world you’re from; whether your country is a kingdom or a republic.

These rights and freedoms mean happiness for everyone.

Everyone has the right to live, to be free and to be safe.

No one can be anyone else’s slave.

No one should be hurt or punished in a cruel or humiliating way.

The law must be the same for everyone.

The law must protect everyone.

Everyone has the right to be defended by the courts, so that their rights are respected.
