vice parroco di Borgio Verezzi ha contestato il Papa durante una messa,
definendolo “un eretico che deve essere convertito”, il parroco
interviene e lo interrompe, ma i fedeli abbandonano la chiesa. Le
critiche erano in relazione alle frasi del Pontefice sulle unioni
civili. Il vescovo, mons. Guglielmo Borghetti, informato del caso, ha
congelato il vice parroco. “Nessun sacerdote dovrebbe mai permettersi di
pronunciare parole simili contro Papa Francesco. Nei confronti di don
Ragusa scatterà un provvedimento disciplinare che limiterà la sua
attività e non sarà più vicario parrocchiale di Borgio Verezzi”.
L’episodio è avvenuto domenica, in occasione della ricorrenza di

Articolo 7, indagini statistiche sulla discriminazione di genere.
Articolo 8, via libera ai centri anti-discriminazione. Ogni articolo
della legge Zan di cui ieri approvato ieri dalla Camera – per oggi è
previsto il voto finale – rappresenta un grande interrogativo e pone
tanti dubbi che vanno a sommarsi a quelli già evidenziati la scorsa
settimana, in riferimento alla prima parte della legge. Non tanto per le
questioni in sé – che certamente vanno affrontate e regolate con norme
efficaci visto che la maggioranza parlamentare considerate inadeguate
quelle esistenti – e neppure per l’opportunità o meno di tutelare le
vittime di discriminazioni e violenze. Un dovere fuori discussione. Ma,
visto che ogni questione decisa a proposito di sesso, orientamento
sessuale e identità di genere apre scenari che vanno a intrecciarsi
strettamente con l’antropologia della differenza sessuale – che per noi
credenti tra l’altro ha radici bibliche – diventa davvero complicato
separare le buone intenzioni dei legislatori dalla cultura a senso unico
che la orienta.

Così appaiono comprensibili le
perplessità, e anche i timori per le eventuali ricadute culturali, che
hanno accompagnato l’approvazione dell’articolo 6, che istituisce la
Giornata nazionale contro l’omofobia, ma soprattutto estende anche alle
scuole elementari iniziative educative «contro l’omofobia, la
lesbofobia, la bifobia e la transfobia». Lo prevede un emendamento della
maggioranza alla legge sulla omofobia approvato dalla Camera
(favorevoli 254, contrari 195 e 6 gli astenuti). Il centrodestra, che
aveva chiesto lo scrutinio segreto non accordato dalla presidenza, aveva
anche presentato sub emendamenti che escludevano scuole elementari e
medie da questi programmi e su questo c’è stato un lungo dibattito.

Così
ora il comma 3 dell’articolo 6 recita: «In occasione della Giornata
nazionale contro l’omofobia, la lesbofobia, la bifobia e la transfobia
–’che sarà il 17 maggio – sono organizzate cerimonie, incontri e ogni
altra iniziativa utile, anche da parte delle amministrazioni pubbliche e
nelle scuole», comprese quelle elementari. L’ora di antidiscriminazione
a scuola presenta – inutile nasconderlo – un rischio ideologico
elevatissimo. Parlare di omofobia, lesbofobia, bifobia ai bambini delle
elementari significa obbligare gli insegnanti ad affrontare temi di
educazione sessuale molto specifici e complessi, ma con un orientamento
definito dalla legge. Quanti saranno i docenti attrezzati per presentare
in modo chiaro, e soprattutto equilibrato, sereno e rispettoso delle
diverse sensibilità questi temi? E quanti, soprattutto, riusciranno a
sfuggire agli schemi più scontati?

Prima dell’approvazione del
discusso articolo 6, l’Aula della Camera aveva dato il via libera anche
all’articolo 7 che impegna tra l’altro l’Istat a presentare, con cadenza
almeno triennale, statistiche sulla discriminazione di genere.
L’articolo modifica il decreto legislativo 9 luglio 2003, n. 215, «in
materia di prevenzione e contrasto delle discriminazioni per motivi
legati all’orientamento sessuale e all’identità di genere».

Dopo
il comma 2 è stato inserito il “2-bis” che recita: «Nell’ambito delle
competenze di cui al comma 2, l’ufficio elabora con cadenza triennale
una strategia nazionale per la prevenzione e il contrasto delle
discriminazioni per motivi legati all’orientamento sessuale e
all’identità di genere. La strategia reca la definizione degli obiettivi
e l’individuazione di misure relative all’educazione e all’istruzione,
al lavoro, alla sicurezza, anche con riferimento alla situazione
carceraria, alla comunicazione e ai media. La strategia è elaborata nel
quadro di una consultazione permanente delle amministrazioni locali,
delle organizzazioni di categoria e delle associazioni impegnate nel
contrasto delle discriminazioni fondate sull’orientamento sessuale e
sull’identità di genere e individua specifici interventi volti a
prevenire e contrastare l’insorgere di fenomeni di violenza e
discriminazione fondati sull’orientamento sessuale e sull’identità di
genere». È stato approvato l’emendamento che modifica così il testo:
«All’attuazione delle misure e degli specifici interventi di cui,
rispettivamente, al secondo e al terzo periodo del comma 2-bis, le
amministrazioni pubbliche competenti provvedono compatibilmente con le
risorse disponibili a legislazione vigente e, comunque, senza nuovi o
maggiori oneri per la finanza pubblica».

L’articolo 8, approvato
subito dopo, riguarda il Fondo per le politiche relative ai diritti e
alle pari opportunità e istituisce i Centri contro la discriminazione.
Iniziativa necessaria? Dipende, come sempre, da chi sarà chiamato a
gestire queste strutture e con quale orientamento. I motivi di
preoccupazione sono evidenti. Il testo dell’articolo spiega che il fondo
viene «incrementato di 4 milioni di euro annui a decorrere dall’anno
2020, al fine di finanziare politiche per la prevenzione e il contrasto
della violenza per motivi legati all’orientamento sessuale e
all’identità di genere e per il sostegno delle vittime». E, come detto,
si istituisce «un programma per la realizzazione, in tutto il territorio
nazionale, di centri contro le discriminazioni motivate da orientamento
sessuale e identità di genere. I centri garantiscono adeguata
assistenza legale, sanitaria, psicologica, di mediazione sociale e ove
necessario adeguate condizioni di alloggio e di vitto alle vittime dei
reati previsti dall’articolo 604-bis del codice penale, commessi per
motivi fondati sull’orientamento sessuale o sull’identità di genere
della vittima, ovvero di un reato aggravato, per le medesime ragioni»,
nonchè i centri sono rivolti anche «a soggetti che si trovino in
condizione di vulnerabilità legata all’orientamento sessuale o
all’identità di genere in ragione del contesto sociale e familiare di
riferimento».

Ma non solo: «I centri svolgono la loro attività
garantendo l’anonimato delle vittime e possono essere gestiti dagli enti
locali, in forma singola o associata, nonchè da associazioni operanti
nel settore del sostegno e dell’aiuto ai soggetti di cui al medesimo
comma. I centri operano in maniera integrata, anche con la rete dei
servizi socio-sanitari e assistenziali territoriali».
