Le multe partono da 3mila euro e arrivano fino a 50mila per una singola operazione e in proporzione alla gravità dell’infrazione. Affinché sul passaggio di denaro non venga imposta la tassa sulle donazioni (con relative sanzioni), è necessario rispettare alcuni piccoli accorgimenti. Il passaggio di denaro deve avvenire, innanzitutto, come prestito infruttifero. Si tratta di un finanziamento tra privati. È, insomma, un modo per aiutare un figlio in maniera semplice ma, soprattutto, regolare. La regola è che, per non avere problemi con il fisco, tutto deve avvenire in forma occasionale. Il che significa che una persona non può concedere del denaro in forma abituale al beneficiario altrimenti decadrebbero i presupposti e diventerebbe un finanziamento che solo le banche e gli operatori abilitati possono fare. Qualcosa che fa storcere il naso a chi non crede in questa norma. Il prestito deve essere poi corredato da una scrittura privata fra le parti in modo tale che l’Agenzia delle entrate possa sapere con certezza da dove proviene il denaro, dove va a finire e per quale scopo. L’ideale è che la scrittura privata venga registrata presso le Entrate (quante giornate devono essere sprecate, per andare a registrare al capoluogo di Provincia dell’Agenzia delle entrate? ), qualora la somma prestata sia cospicua, in modo tale da informare preventivamente il fisco e ottenere il suo consenso. Occorrerà quindi pagare 16 euro di marca da bollo e versare a mezzo modello F24, il 3% della somma, che si intende (regalare al figlio) che si configura come un prestare. Qualcosa che ha dell’incredibile lo Stato tassa anche i regali. Per cifre irrisorie è sufficiente che il passaggio di denaro avvenga tramite bonifico e che riporti nella causale “prestito infruttifero”.
