Luigi de Magistris riflette sui collaboratori di Bonafede costretti alle dimissioni e lo strano intreccio con le sue indagini da magistrato, contestualizzando il tutto alla luce dei recenti terremoti che coinvolgono l’Anm e il Csm.

Il primo mestiere dell’attuale sindaco di Napoli Luigi de Magistris era quello di magistrato presso la Procura di Catanzaro dove rivestiva il ruolo di pubblico ministero. Sono note alle cronache dei primi anni 2000 le sue inchieste “Toghe Lucane”, “Poseidone” e “Why Not” che lo spinsero a indagare proprio sui suoi colleghi.

Il sindaco di Napoli in un lungo post su Facebook riflette sul fatto che vari stretti collaboratori del ministro della Giustizia Alfonso Bonafede si sono dimessi e sull’intreccio che lega alcuni di questi all’urgano che si è abbattuto sull’Associazione nazionale magistrati (Anm) e sul Csm.

De Magistris parte elencando i nomi e i ruoli dei collaboratori di Bonafede che sono stati costretti alle dimissioni e quali accuse mosse contro di loro li hanno costretti a tale decisione.
I collaboratori di Bonafede dimessisi

Andrea Nocera si è dimesso da capo dell’Ispettorato perché indagato per corruzione (il suo ufficio si occupa di accertamenti disciplinari sui magistrati).

Francesco Basentini era il direttore del dipartimento amministrazione penitenziaria (Dap) e si è dimesso dopo le rivolte nelle carceri e i 400 malavitosi posti agli arresti domiciliari, compreso uno dei carcerieri del piccolo Giuseppe Di Matteo sciolto nell’acido dalla mafia. Di questi de Magistris ricorda di essersene interessato durante l’indagine “Toghe Lucane” dove indagò su magistrati che avevano commesso “reati gravi”, scrive il sindaco.

Alle dimissioni è stato costretto anche Fulvio Baldi, il capo di gabinetto del ministro, perché coinvolto nelle intercettazioni sul caso Luca Palamara, l’ex presidente dell’Anm. Quest’ultimo è indagato per corruzione dalla Procura di Perugia, ma de Magistris di Palamara ricorda in particolare l’espressione che proferì quando i magistrati di Salerno provarono a proseguire le sue indagini e furono a loro volta fermati. La frase detta da Palamara riferita dal sindaco di Napoli fu “il sistema ha dimostrato di avere gli anticorpi”.

Ed infine il direttore generale detenuti Giulio Romano che aveva emesso la circolare che ha consentito a numerosi boss di uscire dal carcere. Di questi de Magistris scrive che il suo nome “emergeva agli atti dell’indagine della Procura di Salerno, con riferimento a condotte relative a componenti del Consiglio Superiore della Magistratura”.
Al cuore del Sistema

De Magistris afferma che le sue indagini erano arrivate al cuore del “Sistema”, quello stesso sistema che gravita attorno a Bonafede e che quest’ultimo per “colpa” non ha capito perché “inadeguato al ruolo” e quando non sei all’altezza fa intendere il sindaco di Napoli “il Sistema ti infila come una lama nel burro”.

E poi conclude
“Eravamo arrivati al cuore del sistema criminale che operava nel cuore dello Stato. Eppure nelle decine di interrogatori e testimonianze da me rese alla Procura di Salerno ci sono fatti illeciti gravissimi mai più investigati e nominativi di persone che ancora oggi ricoprono ruoli di primo piano, anche nella magistratura.”

Il 20 maggio il Senato ha bocciato le due mozioni di sfiducia al ministro della Giustizia Alfonso Bonafede presentate dal centrodestra e Emma Bonino di +Europa rispettivamente.
