La polizia monopolizza il processo contro 14 cattolici attivisti. Nuovi arresti e torture

Il
processo doveva essere aperto, ma la sala era piena quasi solo di
poliziotti. Gli accusati, insieme a tre protestanti, sono accusati di
“sovversione” solo per aver denunciato le malefatte dei membri del
Partito. Giustizia e pace condanna il processo-farsa. Il vescovo di Vinh
e decine di intellettuali sostengono l’appello per il rispetto dei
diritti umani in Vietnam. Il governo sta tradendo la costituzione
vietnamita e la Convenzione Onu per i diritti civili e politici. Gli
avvocati difensori denunciano torture, privazioni di sonno e false
testimonianze.

(AsiaNews) – Il processo contro i 14 attivisti cattolici accusati di
sovversione contro lo Stato, si è svolto oggi nella capitale. A
differenza di quanto prima annunciato dalle autorità, nella corte sono
potuti entrare solo poche persone. La sala (v. foto) è stat riempita
quasi completamente da poliziotti per evitare ogni dimostrazione. Per
l’accusa di sovversione, gli imputati rischiano anche la pena di morte. I
giudici hanno rimandato la lettura della sentenza a domani o oltre.
Il processo doveva svolgersi domenica 6 gennaio.
I responsabili del Partito hanno però temuto che essendo giorno di
festa, i cattolici avrebbero potuto usare le messe per spingere persone a
manifestare davanti al tribunale.
Nonostante ciò, anche oggi, fin dal primo mattino, migliaia di
cattolici dalle parrocchie di Yen Dai e Nghi Loc, guidate dal parroco p.
Nguyen Dinh Thuc, hanno cercato di raggiungere la sede del processo
che, secondo le autorità, doveva essere libero e aperto. A un chilometro
dalla sede della corte, il gruppo è stato disturbato da poliziotti e
malviventi ai loro ordini. Tre fedeli sono stati picchiati in modo
selvaggio e poi arrestati.
I cattolici sono stati poi obbligati a stare lontano dal tribunale,
recitando rosari e esponendo cartelli con scritte del tipo: “Protestiamo
contro l’arresto e la detenzione illegale di persone innocenti”; “I
miei fratelli e sorelle sono innocenti”.
In effetti, i 14 cattolici, insieme a tre protestanti, sono
responsabili solo di aver diffuso notizie e critiche sulla corruzione
dei membri del partito e del governo e sul loro arricchirsi durante la
crisi finanziaria. Il governo è sospettato di volere solo soffocare le
loro denunce.
Per tentare di disinnescare critiche contro il governo, giorni fa i
media statali hanno pubblicato la notizia secondo cui tutti gli
arrestati, meno uno – Paul Le Son, un giornalista cattolico – hanno
riconosciuto i loro crimini e hanno chiesto perdono. In realtà, gli
avvocati della difesa hanno precisato ad AsiaNews che nessuno dei
prigionieri si è dichiarato colpevole e hanno accusato la polizia di
aver usato torture, privazione del sonno e false testimonianze per
incastrare gli arrestati.
Il comitato di Giustizia e pace della diocesi di Vinh ha bollato come
“fuorilegge” il processo. In una dichiarazione resa pubblica il 1°
gennaio, Giornata mondiale della pace, si legge: “L’opinione pubblica è
scontenta e tesa per il fatto che un governo dove vige uno stato di
diritto, possa arrestare i suoi cittadini in modo arbitrario senza
accuse fondate. Esso rischia di perdere la sua legittimità,.. rendendo
la gente insicura perché esso va contro le leggi internazionali , la
costituzione e la legge del Vietnam”.
“Una volta di più – continua la dichiarazione – chiediamo al governo e
a tutti di difendere i diritti umani secondo la costituzione del
Vietnam e le leggi internazionali che il Vietnam ha accettato di
attuare, di emendare statuti che sono contro la costituzione e contrari
ai sacri, fondamentali, indiscutibili diritti umani e liberare degli
innocenti. Questo è il solo modo che può aiutare il popolo del Vietnam a
lavorare per la nazione e la sua prosperità, e aiutare il mondo a non
disprezzare il Vietnam per le violazioni ai diritti umani, così che il
popolo possa vivere davvero in pace”.
Il giorno di Natale, anche il vescovo di Vinh, mons. Nguyen Thai Hop,
è intervenuto sull’argomento. Insieme a intellettuali e personalità
della società civile, egli ha sottoscritto un “Appello per difendere i
diritti umani in Vietnam”, chiedendo all’Assemblea nazionale vietnamita
di abolire l’art.88 del codice penale, che punisce la “diffusione di
propaganda contro la Repubblica socialista del Vietnam”, e il decreto
governativo n. 38/2005/ND-CP, del 18 marzo 2005, sulle “misure da
adottare per assicurare l’ordine pubblico”.
Secondo molti osservatori internazionali e personalità locali,
l’art.88 è troppo vago e con la scusa di voler fermare la propaganda
contro la Repubblica socialista del Vietnam, colpisce la libertà di
parola e di espressione riconosciute e garantite dalla costituzione
vietnamita e dalla Convenzione internazionale Onu sui diritti civili e
politici.

As more people are arrested and tortured, police jam-packs courtroom in trial of 14 Catholic activists

The
trial was supposed to be open to the public but the courtroom was
instead filled with police agents. The defendants, plus three
Protestants, are accused of subversion for reporting misdeeds by party
officials. Justice and Peace Committee calls the trial a sham. Vinh
bishop and dozens of intellectuals call on the authorities to respect
human rights. For them, the government is betraying the Vietnamese
constitution and the UN Convention on Civil and Political Rights.
Defendants’ lawyers complain that their clients have been subjected to
torture, including sleep deprivation, and false statements.
Hanoi (AsiaNews) – The trial of 14 Catholic activists charged with
subversion was held today in the Vietnamese capital. Contrary to what the
authorities had announced, only a few visitors were able to enter the courtroom.
Most of the seats were taken instead by police agents deployed to prevent
demonstrations. In view of the charges, the defendants could get the death
penalty. The verdict however will be read tomorrow or later.
Set
to take place on 6 January, the trial was postponed because of the holiday. The authorities were concerned that Catholics could
use the Mass to urge people to demonstrate in front of the courthouse.
Still, at daybreak this morning, thousands of Catholics from the
parishes of Yen Dai and Nghi Loc showed up to walk to the courthouse led by Fr Nguyen
Dinh Thuc, planning to hold the authorities to their word that the trial would
free and open. However, one kilometre from the building, they were stopped by
police and hooligans. Three Catholics were seriously beaten and later arrested.
Forced to stay away from the courthouse, the marchers began reciting the
rosary, holding up placards that said: ‘We protest against the arbitrary and
illegal arrests of innocent people’ and ‘My brothers and sisters are innocent’.
In fact, all that the 14 Catholics, and three Protestants, did was to report
stories and criticism about corrupt party members and government officials who
enriched themselves during the financial crisis. In trying them, the authorities
appear bent on squashing the story.
In order to counter possible criticism against the government, state
media reported that all of those arrested, except for Paul Le Son, a Catholic
journalist, had confessed to their crimes and asked for forgiveness.
However, the defendants’ lawyers told AsiaNews that none of the prisoners had made a confession. Instead,
they accused police of using torture, including sleep deprivation, and making false
statements to implicate the accused.
For the Justice and Peace Committee of the Diocese of Vinh, the trial
violates the law. In a public statement issued on 1 January, World Peace Day,
it said that “public opinion is dissatisfied and agitated by the fact that a
government subject to the rule of law can arbitrarily arrest its citizens on
trumped-up charges. In doing so, it risks losing legitimacy, making people feel
insecure because it goes against international law as well as the constitution
and laws of Vietnam.”
“Once again, we call on the government and on everyone to defend human
rights in accordance with the Constitution of Vietnam and international agreements
that Vietnam has signed. We call for the release of the innocent and for changes
to laws that are against the constitution and against the sacred, fundamental
and indisputable rights of human beings. Only this way will the people of
Vietnam work towards the prosperity of the nation, and the world not show
disdain for Vietnam’s violations of human rights, so that people can truly live
in peace.”
On Christmas day, Vinh Bishop Mgr Nguyen Thai Hop spoke about the issue.
Along with a number of intellectuals and community leaders, he signed an ‘Appeal
to defend human rights in Vietnam.’
In the petition, the signatories call on Vietnam’s National Assembly to
repeal Article 88 of the Vietnam Penal
Code, which criminalises “spreading propaganda against the Socialist Republic
of Vietnam,” and Government Decree No. 38/2005/NĐ-CP of 18 March 2005, which regulars
“measures to ensure public order”.
According to international and local observers, Article 88 is too vague.
With the excuse of fighting propaganda against the Socialist Republic of
Vietnam, it limits freedom of speech and expression, which are recognised and
guaranteed by Vietnam’s constitution and the United Nations Convention on Civil
and Political Rights.

and appeal for her, and for all migrant workers whose situation has
become unsustainable, -

October. Rizana, a minor at the time, was sent to Saudi Arabia – on a
false passport – to work as a care giver. When the child of her employer
died while she was bottle feeding, she was accused of murder and
sentenced to death in a sham trial based on a signed confession, the
content of which she did not know, because it was written in another
language. After obtaining legal protection and a translator, she
retracted the confession, explaining that the tragic death was simply an
accident. But nothing has helped. Fr. Sigamony has been campaigning for
Rizana’s release since 2007. He tells AsiaNews: “We have carried out
many campaigns in Sri Lanka, and collected thousands of signatures that
we sent to the competent authorities in Saudi Arabia. -

attention, thanks to the Caritas network, but without success. ” The
director of Caritas also underlines another aspect of the situation:
“The culprit who sent Rizana to Saudi Arabia illegally [the girl was

opposition, and urge the Government to implement a policy that protects
migrant workers”.
Meanwhile, the Asian Human Rights Commission (Ahcr) has released a
statement: “Do not let Rizana Nafeek become a victim of the infamous

states that there is need for constant pressure to be brought to bear
on the highest authorities, King Abdullah bin Abdul Aziz Al Saud, and
the interior minister, to grant a pardon, and ask forgiveness to the

highest rates of executions in the world. According to Amnesty
International statistics on death sentences, at least 69 were executed
in Saudi Arabia in 2009, 102 in 2008. In late 2009, Amnesty
International denounced the presence of at least 141 people on death row
in Saudi Arabia, including 104 foreign nationals. Migrant workers from
Africa, Asia and the Middle East are the main victims.

by the Asian Human Rights Commission (AHRC). Appeal from Government of
Sri Lanka to renew diplomatic efforts. The young woman on death row
since 2007. She can only be released if pardoned by parents who accuse
her of murdering their baby. -
